AN ORDINANCE TO AMEND CHAPTER 301,WAUKEE MUNICIPAL CODE,
ZONING ORDINANCE OF THE CITY OF WAUKEE,IOWA,BY REZONING AND
CHANGING CERTAIN PROPERTY THEREIN FROM A-I [AGRICULTURAL DISTRICT]
TO C-l [COMMUNITY AND IDGHWAY SERVICE COMMERCIAL DISTRICT];AND
AMEND THE OFFICIAL ZONING MAP TO SHOW REZONING.
BE IT ORDAINED by the Council ofthe City of Waukee:
Section 1.Section 301.4 of Chapter 301,Waukee Municipal Code,Zoning Ordinance of
the City,adopting the Official Zoning Map,is hereby amended by changing the following real estate
from A-I (Agricultural District)to C-1 (Community and Highway Service Commercial District),
legally described as follows:
THE SOUTHEAST Y.OF THE SOUTHEAST Y.AND THE SOUTHWEST FRACTIONAL Y.
OF THE SOUTHEAST Y.OF SECTION 7,TOWNSHIP 78 NORTH OF RANGE 26 WEST
OF THE 5TH P.M.,DALLAS COUNTY,IOWA EXCEPT LAND DEEDED TO THE STATE
OF IOWA FOR HIGHWAY PURPOSES RECORDED IN BOOK 442,PAGE 617.
AND,
COMMENCING AT THE SOUTHWEST CORNER OF SECTION 8,TOWNSHIP 78
NORTH,RANGE 26 WEST OF THE 5TH P.M.,DALLAS COUNTY,IOWA,THENCE
NORTH ALONG THE WEST LINE OF SAID SECTION 8,235.8 FEET TO THE POINT OF
BEGINNING;THENCE NORTH ALONG THE WEST LINE OF SAID SECTION 8,1080.6

Also known as the Frank and Melba Scaglione property or the West Central Auto Auction,Inc.
property.
Section 2.Repealer,All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance shall be
adjudged invalid or unconstitutional,such adjudication shall not affect the validity ofthe ordinance as
a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional.ISection4.Effective Date.This ordinance shall be in effect upon its final passage,approval
and publication as provided by law.
Passed by the City Council of the City of Waukee,Iowa,this 1st day of May 2006,and approved this
1st day of May 2006.
