AN ORDINANCE AMENDING SECTION 303.158(A)TO CLARIFY THE
PAYMENTS DUE UPON APPLICATION FOR A BUILDING PERMIT.
WHEREAS,the City of Waukee has previously established connection fee
districts for the purpose of recovering the equitable costs of extending water and sewer
services to property;and
WHEREAS,certain connection fee districts provide for the payment of said costs
upon application for a building permit,namely chapters 224W &224X ofthe Waukee
Municipal Code;and
WHEREAS,the City desires to clarify the fees due upon application for a
building permit and harmonize the various provisions of the code pertaining to said fees
and payments and eliminate duplicative provisions in the code.
NOW,THEREFORE,BE IT ORDAINED by the City Council ofthe City of Waukee §
303.I 58(A)and its subparts (1-6)should be and the same is hereby repealed and enacted
in lieu thereof is §303.158(A)as follows:
§303.158(A)Connection Fees.Those connection fees established pursuant to Chapters
224W &224X ofthe Waukee Municipal Code.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance
shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity
of the ordinance as a whole or any section,provision,or part thereof not adjudged invalid or
unconstitutional.
Section 5.Effective Date.This ordinance shall be in effect upon its [mal passage,
approval and publication as provided by law.
