AN ORDINANCE TO AMEND CHAPTER 204B,CONSTRUCTION SITE EROSION AND
SEDIMENT CONTROL (COSESCO),BY AMENDING SECTION 204B.03,SITE VISIT
PROCEDURES FOR COSESCO,SUBSECTION 3.4,THROUGH THE ADDITION OF
CERTAIN LANGUAGE SO THAT THE CITY MAY EXTEND THE DEADLINE FOR
COMPLETING CORRECTNE ACTION AT THE CITY'S SOLE DISCRETION
BE IT ORDAINED by the City Council of the City of Waukee:
Section 1:Chapter 204B,Construction Site Erosion and Sediment Control (COSESCO),
Waukee Municipal Code,Section 204B.03,Site Visit Procedures for COSESCO,subsection 3.4,is
hereby amended by changing certain language so that the City may extend the deadline for completing
corrective action at the City's sole discretion,so that said subsection reads as follows:
3.4 In the event a site visit identifies an area or incident of non-compliance,the City may,at its
discretion,provide applicant with a list of deficiencies that identifies the area or incident of
non-compliance.In the event an enforcement action is taken,a list of deficiencies must first
be provided to applicant.If a list of deficiencies is provided,the applicant shall immediately
commence corrective action and shall complete corrective action within forty eight (48)
hours of receiving the list.For good cause shown,the City may extend the deadline for
completing corrective action,at the City's sole discretion.Failure to take corrective action in
a timely manner shall constitute a violation ofthis ordinance.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions of
this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance shall be
adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as
a whole or any section,provisions or part thereof not adjudged invalid or unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect from and after its final passage,
approval and publication as provided by law.
