AN ORDINANCE TO AMEND SECTION 303.140,WAUKEE MUNICIPAL CODE,
SUBDNISION REGULATIONS ORDINANCE OF THE CITY OF WAUKEE,IOWA,TO
PROVIDE TIIAT SUBDNIDERS SHALL BE RESPONSIBLE FOR PAYMENT OF ALL
COSTS OF INSTALLING THE NATURAL GAS SYSTEM WITHIN ALL NEW
SUBDNISIONS BY DELETING SECTION 303.140,AND INSERTING IN LIEU THEREOF,
"THE SUBDNIDER SHALL BE RESPONSIBLE FOR THE PAYMENT OF ALL COSTS OF
INSTALLING THE NATURAL GAS SYSTEM WITHIN ALL NEW SUBDNISIONS.THE
NECESSARY PIPING AND APPURTENANCES SHALL BE INSTALLED BY THE CITY
AND ALL COSTS,INCLUDING COSTS OF YARDAGE AND MATERIAL HANDLING,
ENGINEERING,INSPECTION,ADMINISTRATIVE FEES,AND ALL OTHER FEES ABOVE
AND BEYOND THE NORMAL CONSTRUCTION SHALL BE BILLED TO AND PAID BY
THESUBDNIDER."
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 303.140,Waukee Municipal Code,Subdivision Regulations of the City,
is hereby amended by deleting said section and inserting in lieu thereofthe following:
§303 .140.The Subdivider shall be responsible for the costs of installing the natural
gas system within all new subdivisions.The necessary piping and appurtenances
shall be installed by the City and all costs,including costs of all yardage and
material handling,engineering,inspection,administrative fees,and all other fees
above and beyond the normal construction,shall be billed to and paid by the
Subdivider.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance shall be
adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance
as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its final passage,
approval and publication as provided by law.
Passed by the City Council ofthe City of Waukee,Iowa,this 14th day of February 2005,and
approved this 14th day of February 2005.
