AN ORDINANCE TO ESTABLISH A CONNECTION FEE DISTRICT AND FEES
FOR CONNECTION OF PROPERTY IN SAID DISTRICT TO THE HICKMAN SEWER
DISTRICT 2001 TO RECOVER THE EQUITABLE PORTION OF TIIE COSTS TlIEREOF.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Connection Fee District and Fees For Connection of Property Therein
to the Hickman Sewer District 2001.There is hereby established Connection Fee District to be
known as Hickman Sewer District 2001 for connection of the property described herein to the
Hickman Sewer District 2001 and providing for fees therefore.
A.The following described real estate is hereby designated as Hickman
Sewer District 2001:
Beginning at the northwest comer of the southwest quarter of the southwest quarter of Section
26,Township 79 North,Range 26 West;thence easterly to the northeast comer of the southwest
quarter of the southwest quarter of said Section 26;thence southerly to a point one thousand
thirty-four and five tenths (1,034.5)feet north ofthe south line of said Section 26;thence easterly
three hundred (300.0)feet;thence southerly four hundred ninety-four and five tenths (494.5)
feet;thence southeasterly three hundred eighty-seven and thirty-three hundredths (387.33)feet
more or less;thence southerly two hundred ninety-five (295.0)feet to a point on the south line of
said Section 26;thence westerly along the south line of said Section 26 to a point six hundred
sixty (660)feet east ofthe southwest comer of said Section 26;thence northerly three hundred
thirty (330.0)feet;thence westerly six hundred sixty (660.0)feet to the west line of said Section
26;thence northerly along the west line of said Section 26 to the point of beginning;except for
highway right-of-way,streets and roads.
B.A connection fee is hereby established and imposed upon the owners of
property within Hickman Sewer District 2001 who shall hereafter make application to connect
their property to the Hickman Sewer District 2001,or sewer lines connected thereto.The
connection fee shall be computed as follows:
Total Project Cost:$690,727.10
Total Benefited Area:
Area in Special Assessment 246.64 Acres
Area in Connection Fee District 43.20 Acres
Reserve Undesignated Area 20.00 Acres
TOTAL AREA 309.84 Acres
Cost per Acre:$690,727.10 7 309.84 acres =$2,229.30.
The project completion and special assessment schedule was dated January 3,2002.The
connection fee will escalate at 9%per year.

C.The following provisions for connection of property within the connection
fee district,in existence or under construction upon the effective date of this ordinance,and the
following procedures for future division of property within the benefited district shall be
applicable:
All property located within the corporate limits of the City of Waukee and
within Hickman Sewer District 2001 shall be eligible for connection to the Hickman
Sewer District 2001 upon approval of an application for connection by the owner thereof,
as provided by the City of Waukee,and payment of the connection fee for such property,
provided that capacity in said sewer is then available;provided such property has been
appropriately subdivided for development;and further provided that all sanitary sewer
improvements necessary to serve said property have been constructed and approved by
the City.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance shall
be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the
ordinance as a whole or any section,provision,or part thereof not adjudged invalid or
unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its final passage,
approval and publication as provided by law.
