HomeMy WebLinkAbout2005-02-28-Ordinance 2506_R-22 Sewer Connection Fee DistrictORDINANCE NO.2506 AN ORDINANCE TO ESTABLISH A CONNECTION FEE DISTRICT AND FEES FOR CONNECTION OF PROPERTY IN SAID DISTRICT TO THE R22 SEWER DISTRICT TO RECOVER THE EQUITABLE PORTION OF THE COSTS THEREOF. BE IT ORDAINED by the Council of the City of Waukee: Section 1.Connection Fee District and Fees For Connection of Property Therein to the R22 Sewer District.There is hereby established Connection Fee District No.One (1)for connection of the property described herein to the R22 Sewer District and providing for fees therefore. A.The following described real estate is hereby designated as Connection Fee District No.One (1)ofthe R22 Sewer District: Zone 1 An area in the west half of Section 5,Township 78 North,Range 26 West of the 5thP.M.,Dallas County,Iowa,more particularly described as follows: That part of each tract of land described below in the west half of said Section 5 which lies between the east right-of-way of County Road R-22 (also known as Ute Avenue and 6th Street)and a line 300 feet east of and adjacent to the east right-of-way line of County Road R-22 as presently established,with said tracts described as follows:Government Lot 4,except Parcels A,Band C;Government Lot 5; Govemment Lot 12 except that part lying south of 312'h Place. Also that part of Govemment Lot 12 which lies between COlU1tyRoad R-22 west right-of-way and a line 300 feet west of and adjacent to the west right-of-way line of County Road R-22 in said Section 5. Zone 2 Two areas in the west half of Section 8,Township 78 North,Range 26 West of the 5th P.M.,Dallas County,Iowa,more particularly described as follows: 1.That part of Lot 6 of Leonard's Subdivision in the SW 1/4 of Section 8,Township 78 North,Range 26 West of the 5th P.M.,which lies between the west right-of-way line of County Road R-22 and a line 300 feet west of and parallel to the west right-of-way line of County Road R-22. 2.That part of Parcel A and Parcel B in Lot 2 ofHunsber~er Proprietor Plat 1 in Section 8,Township 78 North,Range 26 West of the s'P.M.,which lies between the east right-of-way line of County Road R-22 and a line 300 feet east of and parallel to the east right-of-way line of County Road R-22. B.A connection fee is hereby established and imposed upon the owners of property within Connection Fee District No.One (1)of the R22 Sewer District who shall hereafter make application to connect their property to the R22 Sewer District or sewer lines connected thereto.The connection fee shall be computed as follows: Total Project Cost,Zone 1:$409,513.69 Total Benefited Area:142.62 acres Cost per Acre:$409,513.69.+142.62 acres =$2,871.36 Properties in Zone 1 which have paid a special assessment for the R-22 Sanitary Sewer Improvements will be credited the amount paid against the connection fee. Total Project Cost,Zone 2:$367,630.08 Total Benefited Area:33.78 acres Cost Per Acre:$367,630.08.+33.78 acres =$10,883.07** **This amount is reduced to $9,285.95 per acre due to a cost limitation imposed by the special assessment process of the R-22 Sanitary Sewer Improvements. Properties in Zone 2 which have paid a special assessment for the R-22 Sanitary Sewer Improvements will have the special assessment principal amount credited against the connection fee. The connection fee will escalate at 9%per year,beginning January 1,2005. Section 2.Repealer.All ordinances or parts of ordinances 111 conflict with the provisions ofthis ordinance are hereby repealed. Section 3.Severability Clause.If any section,provision or part of tins ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional. Section 4.Effective Date.This ordinance shall be in effect upon its final passage, approval and publication as provided by law.
