HomeMy WebLinkAbout2005-03-14-Ordinance 2508_Signage Regulations, Window SignsORDINANCE NO.2508 AN ORDINANCE TO AMEND CHAPTER 305,SECTION 305.4(H),WAUKEE MUNICIPAL CODE,SIGN ORDINANCE,BY ADDING AS SUBSECTION '4'THE FOLLOWING:"WINDOW SIGNS:ALL WINDOW SIGNS,WHETHER TEMPORARY OR PERMANENT,SHALL BE RESTRICTED TO NO MORE THAN TEN (10)PERCENT OF THE SIZE OF THE APPLICABLE WINDOW AREA.TYPICAL WINDOW SIGNS INCLUDE,BUT ARE NOT LIMITED TO:PAINTED SIGNAGE,NEON BEVERAGE SIGNS, SALE AND PRODUCT ADS,ETC.LARGER SIGNAGE CAN BE PERMITTED ON A TEMPORARY BASIS PURSUANT TO SECTIONS 305.4(H)(5)AND 305.4(H)(6)AS RENUMBERED.EXCEPTIONS TO rms ITEM INCLUDE SEASONAL NON- COMMERCIAL ITEMS AND LOCAL OR SCHOOL RELATED EVENTS (E.G., HOMECOMING WINDOW PAINTING)";AND BY RENUMBERING IN NUMERICAL ORDER EACH SUBSECTION THEREAFTER. BE IT ORDAINED by the Council ofthe City of Waukee: Section 1.Chapter 305,Waukee Municipal Code,Sign Ordinance,Section 305.4(H)is hereby amended by adding the following as subsection '4': 4.Window Signs:All window signs,whether temporary or permanent,shall be restricted to no more than ten (10)percent of the size of the applicable window area.Typical window signs include,but are not limited to:painted signage,neon beverage signs,sale and product ads,etc.Larger signage can be permitted on a temporary basis pursuant to Sections 305.4(H)(5)305.4(H)(6). Exceptions to this item include seasonal non commercial items and local or school related events (e.g.homecoming window painting). Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3.Severability Clause.If any section,provision or part of this ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional. Section 4.Effective Date.This ordinance shall be in effect upon its final passage, approval and publication as provided by law.
