AN ORDINANCE TO AMEND CHAPTER 301,WAUKEE MUNICIPAL CODE,ZONING
ORDINANCE OF THE CITY OF WAUKEE,IOWA,BY RE-ZONING AND CHANGING ''I
CERTAIN PROPERTY THEREIN FROM A-I (AGRICULTURAL DISTRICT)TO R-2 (ONE AND
TWO FAMILY RESIDENTIAL DISTRICT)AND AMEND THE OFFICIAL ZONING MAP TO
SHOW RE-ZONING.
BE IT ORDAINED by the Council ofthe City of Waukee:
Section 1.Section 301.4 of Chapter 301,Wankee Municipal Code,Zoning Ordinance of
the City,adopting the Official Zoning Map,is hereby amended by changing the following described
real estate from A-I (Agricultural District)to R-2 (One and Two Family Residential District),and
that the Official Zoning Map be made to reflect such amendment:
GOVERNMENT LOT 12 AND THE SOUTH 33 FEET OF GOVERNEMENT LOT 5 ALL IN
SECTION 4,TOWNSHIP 78 NORTH,RANGE 26 WEST OF THE 5TH P.M.,DALLAS
COUNTY,IOWA,EXCEPT BEGINNING 184.4 FEET SOUTH OF AN IRON PIN AT THE
NORTHWEST CORNER OF GOVERNMENT LOT 12 IN SECTION 4-78-26 WEST OF THE
5TH P.M.,DALLAS COUNTY,IOWA,THENCE EAST 358.8 FEET;THENCE NORTH 261.4
FEET;THENCE SOUTHWESTERLY (BEARING SOUTH 87 4'WEST)ON A LINE 33.0 FEET
NORTH OF AND PARALLEL TO THE NORTH LINE OF SAID GOVERNMENT LOT 12,
359.6 FEET TO THE WEST SECTION LINE OF SAID SECTION 4,THENCE SOUTH 217.4
FEET TO THE POINT OF BEGINNING;AND GOVERNMENT LOT 8 IN SECTION 5,
TOWNSHIP 87 NORTH,RANGE 26 WEST OF THE 5TH P.M.,DALLAS COUNTY,IOWA,
SUBJECT TO ALL EASEMENTS OF RECORD,CONTAINING 38.520 ACRES,LESS ROAD }
RIGHT-OF-WAY.
Also known as a parcel to be known as Grant Park.
Section 2.A Preliminary Plat must be presented and approved within two years of final
passage of this rezoning.If this requirement is not met the property will revert back to A-I zoning.
Section 3.Repealer,All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 4.Severability Clause.If any section,provision or part ofthis ordinance shall be
adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as
a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional.
Section 5.Effective Date.This ordinance shall be in effect upon its final passage,approval
and publication as provided by law.
Passed by the City Council of the City of Waukee,Iowa,this 4th day of April 2005,and approved this
4th day of April 2005.
