)AN ORDINANCE TO AMEND CHAPTER 301,WAUKEE MUNICIPAL CODE,
ZONING ORDINANCE OF THE CITY OF WAUKEE,IOWA,BY AMENDING SECTION
301.14(C),"R-4"ROW DWELLING AND TOWNHOME DISTRICT,BULK REGULATIONS,
BY REPLACING LANGUAGE IN SUBSECTION 3,MINIMUM FLOOR AREA,THAT
READS "750 SQUARE FEET PER UNIT"WITH LANGUAGE THAT READS "800 SQUARE
FEET PER UNIT."
BE IT ORDAINED by the Council ofthe City of Waukee:
Section I.Chapter 301,Waukee Municipal Code,Zoning Ordinance,Section 301.14(C)is
hereby amended Subsection 3,Minimum Floor Area,with the following:
3.Minimum Floor
Area:800 square feet per unit,
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions
ofthis ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision orpart of this ordinance shall be
adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance
as a whole or ally section,provision,or part thereof not adjudged invalid or unconstitutional.ISection4.Effective Date.This ordinance shall be in effect upon its final passage,
approval and publication as provided by law.
Passed by the City Council of the City of Waukee,Iowa,this 6th day of June 2005,and approved
this 6th day ofJune 2005.
