AN ORDINANCE TO AMEND CHAPTER 301,WAUKEE MUNICIPAL CODE,
ZONING ORDINANCE OF THE CITY OF WAUKEE,row A,BY AMENDING SECTION
301.17(C),"C-l"COMMUNTTY AND HIGHWAY SERVICE COMMERCIAL DISTRICT,
BULK REGULATIONS,BY ADDING "SUBSECTION 8,BUILDING AREA",THAT
READS:"NO SINGLE BUILDING WITHIN THIS DISTRICT SHALL EXCEED 50,000
SQUARE FEET.(NO CONFIGURATION OF BUILDINGS SHALL BE ALLOWED THAT
ARE PLANNED OR INTENDED TO CIRCUMVENT THIS REQUIREMENT.)"
BE IT ORDAINED by the Council ofthe City of Waukee:
Section 1.Chapter 301,Waukee Municipal Code,Zoning Ordinance,Section 301.17(C)is
hereby amended by adding Subsection 8,Building Area so that it reads as follows:
8.Building Area No single building within this district shall exceed
50,000 square feet.(No configuration of buildings
shall be allowed that are intended or planned to
circumvent this requirement.)
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 3.Sevembility Clause.If any section,provision or part of this ordinance shall be
adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance
as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional.
Section 4.EfIective Date.This ordinance shall be in effect upon its final passage,
approval and publication as provided by law.
Passed by the City Council ofthe City of Waukee,Iowa,this 1st day of August 2005,and approved
this 1st day of August 2005.
