AN ORDINANCE TO AMEND CHAPTER 303,WAUKEE MUNICIPAL CODE,
LAND SUBDIVISION REGULATIONS OF THE CITY OF WAUKEE,IOWA,BY
AMENDING SECTION 303.150,"TIME PERIOD",SO THAT IT READS:"THE
SUBDIVIDER SHALL BE REQUIRED TO MAINTAIN ALL REQUIRED IMPROVEMENTS
FREE OF DEFECTS DUE TO FAULTY MATERIALS AND WORKMANSHIP AFTER
ACCEPTANCE OF CERTIFICATE OF COMPLETION OF SAID IMPROVEMENTS BY
THE CITY COUNCIL FOR A PERIOD SPECIFIED BELOW."
WHEREAS,the City of Waukee is has determined that of the time periods for subdividers
to maintain required improvements should be the uniform and extend for a period of 4 years.
BE IT ORDAINED by the Council ofthe City of Waukee:
Section 1.Chapter 303,Waukee Municipal Code,Land Subdivision Regulations,Section
303.150 is hereby repealed and enacted in lieu thereof and is as follows:
303.150 Time Period.The Subdivider shall be required to maintain all required
improvements free of defects due to faulty materials and
workmanship after acceptance Certificate of Completion of
said improvements by the city council for a period
specified below:
Sanitary Sewer
Water Main
Storm Sewer
Pavement
Sidewalks
four (4)years
four (4)years
four (4)years
four (4)years
four (4)years
Section 2.Purpose.The purpose of the amendment is to increase the length to four years
for certain improvements installed by a subdivider.
Section 3.Repealer.All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 4.Severability Clause.If any section,provision or part of tins ordinance shall be
adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance
as a whole or ally section,provision,or part thereof not adjudged invalid or unconstitutional.
Section 5.Effective Date.This ordinance shall be in effect upon its final passage,approval
and publication as provided by law.
Passed by the City Council ofthe City of Waukee,Iowa,tins 29th day of August 2005,and
approved tins 29th day of August 2005.
