HomeMy WebLinkAbout2004-12-20-Ordinance 2497_Utilities Committee, Establish ERROR IN DATEORDINANCE NO.2497 AN ORDINANCE TO AMEND THE WAillffiE MUNICIPAL CODE,BY ADDING THEREIN CHAPTER 227,CONFIRMING THE ESTABLISHMENT, POWERS AND DUTIES OF THE UTILITIES COMMITTEE,A STANDING COMMITTEE OF THE CITY OF W AUI(EE,FOR THE PURPOSE OF CLARIFICATION OF MEMBERSHIP,DUTIES AND ROLE OF COMMITTEE BE IT ENACTED by the Council of the City of Waukee: §227.1 Purpose.The purpose of this ordinance is to provide for the establishment of a Utilities Connnittee as a standing committee of the City of Waukee. §227.2 Committee Members.The Utilities Committee consists of the Director of Public Works,seven citizen members and one council member as an ex officio member of the committee.All committee members,other than the council member and the Director,are to be appointed or re-appointed by the mayor with the approval of the council and are subject to removal without cause by mayor/council.The council member is appointed annually by the mayor. §227.3 Qualifications of Committee Members.Each committee is made up of residents of the city of Waukee,Iowa,and all shall be over the age of eighteen (18). §227.4 Organization ofthe Utilities Committee. A.Length ofTenns.All citizen member appointments to the Utilities Connnittee shall be for three (3)years,except to fill vacancies.Each term shall connnence on January I st with appointment being made during the council meeting held on the first Monday in January.Appointments shall be made every year of one-third of the total number as near as possible,to stagger the terms.The present incumbents or appointees for 2005 are to be confirmed in their appointments and staggered in their terms in such a manner that Two members are to be assigned to a one year term Two members are to be assigned to a two year term Three members are to be assigned to a three year term, B.Vacancies.The position of any committee member shall be vacant if the member moves permanently from the city;or ifhe/she is absent without due explanation from four (4)consecutive meetings of the connnittee, except in the case of sickness or if he/she is removed for cause by the mayor with the approval of the city council.The mayor,with approval of the council,shall fill any vacancy by appointment of a new committee member to fill the unexpired term. C.Quorum and Voting.All action by the committee,if any,shall require a majority vote of the whole number ofmembers appointed by the council. D.Officers.Officers of the committee shall include a chair person and vice chair person.Each shall be elected for a one year term. E.Compensation.The committee members shall receive no compensation for their services. §227.5 Powers and Dnties.The Utilities Committee,as a standing committee,shall perform a continuing function of providing information,review or research of a topic which is to come before the council.The Utilities Committee may report its findings to the councilor make recommendations as warranted, A.After each annual appointment is made,the Utilities Committee members shall elect a chair person,vice chair person and a secretary to serve as officers of the committee for the current year. B.The Utilities Committee shall meet at the call of the Director of Public Works on the third Tuesday of the month at 7:00 P.M.in the City Hall Council Chambers or on a date deemed necessary by the Director of Public Works with the consent of the Chair Person. §227.6 Repealer.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. §227.7 Saving Clause.If any section,provision or part of this ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity or the ordinance as a whole or any section,provision,or part not adjudged invalid or unconstitutional. §227.8 Effective Date.The ordinance shall be in effect after its final passage,approval,and publication as required by law.
