HomeMy WebLinkAbout2005-10-17-Ordinance 2537_Gas Service to Legal EntitiesORDINANCE NO.2537 AN ORDINANCE REQUIRING PERSONAL GUARANTEES FOR CITY GAS SERVICE TO LEGAL ENTITIES AND SPECIFYING THE PAYMENT DUE DATE. WHEREAS,the City of Waukee maintains gas and water utilities for the purpose of serving its citizens;and WHEREAS,legalentities such as corporations,limited liability companies and partnerships pose difficulties in obtaining payment for delinquent bills should they become insolvent which burdens the City Utility and ultimately the customers of the utilities as a whole;and WHEREAS,it is in the best interest of the City Gas Utilities to minimize the risk of accruing uncollectible bills the City is desirous of providing certain requirements for customers who are legal entities. NOW,THEREFORE,BE IT ORDAINED by the City Council of the City of Waukee that the following should be and the same is hereby enacted: §202.10 payment responsibility.By obtaining gas service from the gas utility the customer agrees to be bound by the ordinances,resolutions and policies goveruing the City Gas Utility.All customers having service shall be responsible for the payment of gas payments on or before the due date.A legal entity,which does not own the property for which gas service is to be provided,seeking to obtain Gas service shall provide a personal guarantor who guarantees the payment of any and all obligations due to the Gas Utility relating to the service provided to said entity. BE IT FURTHER ORDAINED by the City Council of the City of Waukee that section 202.5 should be and the same is hereby repealed and enacted in lieu thereof is as follows: §202.5 Payment.Bills for gas service shall be mailed the last weekday of the month.Gas payments shall be due on or before the 20th day of the following month.A late payment penalty shall be assessed equal to 1.5%of the outstanding balance for any payments not received by the first business day following the due date. Section 1.Repealer.All ordinances or parts of ordinances or resolutions in conflict with the provisions of this ordinance are hereby repealed. Section 2.Severability Clause.If any section,provision or part of this ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional. Section 3.Effective Date.This ordinance shall be in effect upon its fmal passage, approval and publication as provided by law.
