AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY
OF WAUKEE,IOWA,BY ADDING PROVISIONS PERTAINING TO THE
DEFINITION OF THE CRIME OF ASSAULT AND PROVIDING THE
PUNISHMENT THEREFOR
BE IT ORDAINED by the City Council ofthe City of Waukee,Iowa:
SECTION 1.Chapter 601 of the Municipal Code of the City of Waukee,Iowa is hereby
amended by the addition of the following subparagraph of Chapter 601.1 as an exception to the
definition of assault:
Provided,where the person doing any of the above-enumerated acts is employed
by a school district or accredited non-public school,or is an area education
agency staff member who provides services to a school or school district,and
intervenes in a fight or physical struggle,or other disruptive situation that takes
place in the presence of the employee or staff member performing employment
duties in a school building,on school grounds or at an official school function
regardless of the location,the act shall not be an assault.
SECTION 2.Chapter 601.2 of the Municipal Code of the City of Waukee is hereby
repealed and the following adopted in lieu thereof:
§601.2 Penalty.Any violation of the provisions of this chapter shall be
considered a simple misdemeanor as provided in Chapter 620 of this Code.
SECTION 3.SEVERABILITY CLAUSE.If any section,provision or part of this ordinance
shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the
ordinance as a whole or any section,provision,or part thereof not adjudged invalid or
unconstitutional.
SECTION 4.WHEN EFFECTIVE.This ordinance shall be in effect from and after its final
passage,approval and publication as provided by law.
Passed by the Council the 7'11 day of November 2005,and approved this 7'11 day of November
2005.
