AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY
OF WAUKEE,lOW A,BY AMENDING AND ADDING PROVISIONS
PERTAINING TO THE DEFINITION OF THE CRIME OF
HARASSMENT AND PROVIDING THE PUNISHMENT THEREFOR
BE IT ORDAINED by the City Council of the City of Waukee,Iowa:
SECTION 1.Chapter 602.2 and 602.3 of the Municipal Code of the City of Waukee,Iowa are
hereby repealed and the following adopted in lieu thereof:
§602.2 Personal Contact.A person commits harassment when the person
purposefully and without legitimate purpose,has personal contact with another
person,with the intent to threaten,intimidate or alarm that other person.As used
in this section,unless the context otherwise requires,"personal contact"means an
encounter in which two or more people are in visual or physical proximity to each
other."Personal contact"does not require a physical touching or oral
communication,although it may include these types of contact.
§602.3 Penalty.Any violation of the provisions of this chapter shall be
considered a simple misdemeanor as provided in Chapter 620 ofthis Code.
SECTION 2.SEVERABILITY CLAUSE.If any section,provision or part of this ordinance
shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the
ordinance as a whole or any section,provision,or part thereof not adjudged invalid or
unconstitutional.
SECTION 3.WHEN EFFECTIVE.This ordinance shall be in effect from and after its final
passage,approval and publication as provided by law.
Passed by the Council the 7'h day of November 2005,and approved this 7'h day of November
2005.
