AN ORDINANCE AMENDING CHAPTER 605 OF THE MUNICIPAL
CODE OF THE CITY OF WAUKEE,IOWA,BY DELETING SAID
CHAPTER AND INSERTING IN LIEU THEREOF 605.1 AND
INCORPORATING SECTIONS OF THE IOWA CODE DEFINITIONS
OF FRAUDULENT PRACTICES BY REFERENCE THERETO AND
PROVIDING THE PUNISHMENT THEREFOR.
BE IT ORDAINED by the City Council of the City of Waukee,Iowa;
SECTION 1.Chapter 605 of the Municipal Code of the City of Waukee,Iowa is repealed and
the following adopted in lieu thereof:
605.1 Fraud.It is unlawful for any person to commit a fraudulent practice as
defmed in §714.8 ofthe Code ofIowa.A person who does any of the fraudulent
practices as defmed in §714.8 of the Code ofIowa is guilty of fraudulent practice
for purposes of this chapter where the amount or value of property or services
involved does not exceed $200.00.
605.2 Penalty.Any violation of the provisions of this chapter shall be considered a
simple misdemeanor as provided in Chapter 602 of this Code.
SECTION 2.SEVERABILITY CLAUSE.If any section,provision or part of this ordinance
shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the
ordinance as a whole or any section,provisions or part thereof not adjudged invalid or
unconstitutional.
SECTION 3.WHEN EFFECTIVE.This ordinance shall be in effect from and after its final
passage,approval and publication as provided by law.
Passed by the Council the 7'h day of November 2005,and approved this 7th day of November
2005.
