AN ORDINANCE TO AMEND CHAPTER 303,WAUKEE MUNICIPAL CODE,BY
REPEALING THE EXISTING SITE IMPROVEMENT REQUIREMENTS AND
ENACTING NEW SITE IMPROVEMENT REQUIREMENTS AS SPECIFIED BELOW:
WHEREAS,the City of Waukee has detennined to change the site improvement
requirements.
BE IT ORDAINED by the City Council of the City of Waukee:
Section 1:Chapter 303,Waukee Municipal Code,Section 303.157(D)should be and the
same is hereby repealed and enacted in lieu thereof is as follows:
D.Site Improvements
In addition to the dedication ofland this ordinance requires the provision of initial
development for neighborhood parks.The following will be required of any
development adj acent to a neighborhood park.
Reasonable improvements and access to the land dedicated,including,but not
limited to,full street improvements and utility connections such as curbs,gutters,
street paving,traffic control devices,street trees,and sidewalks.
On site improvements including,but not limited to,grading,seeding and planting,
picnic area and shelter,connecting trails and parking shall be required.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance shall
be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the
ordinance as a whole or any section,provisions or part thereof not adjudged invalid or
unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect from and after its final
passage,approval and publication as provided by law.
Passed by the Council the 19th day of December,2005,and approved this 19th day of December,
2005.
