AN ORDINANCE AMENDING SECTION 301.13,WAUKEE MUNICIPAL
CODE,ZONING ORDINANCE OF THE CITY OF WAUKEE,IOWA,"R-3"MULTI
FAMILY RESIDENTIAL DISTRICT,BY DELETING §301.13(A)(2)AND INSERTING
IN LIEU THEREOF THE FOLLOWING:"MULTIPLE FAMILY DWELLINGS
(APARTMENTS AND CONDOMINIUMS),EXCLUSIVE OF ROW DWELLINGS AND
TOWNHOMES,CONSISTING OF NOT MORE THAN TWENTY-FOUR (24)
DWELLING UNITS IN ONE BUILDING."
BE IT ORDAINED by the Council ofthe City of Waukee:
Section 1.Section 301.13(A)(2),Waukee Municipal Code,
Zoning Ordinance of the City of Waukee,Iowa,"R-3"Multi Family
Residential District,is hereby amended by deleting §301.13(A)(2)and
inserting in lieu thereofthe following:
§301.13(A(2)."Multiple family dwellings (apartments and
condominiums),exclusive of row dwellings and
townhomes,consisting of not more than twenty-four (24)
dwelling units in one building.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with
the provisions of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this
ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not
affect the validity of the ordinance as a whole or any section,provision,or part
thereof not adj udged invalid or unconstitutional.
Section 4.Effective Date.TIns ordinance shall be in effect upon its finai
passage,approval and publication as provided by law.
Passed by the City Council of the City of Waukee,Iowa,this 20th day of January
2004,and approved this zo"day of January 2004.
