AN ORDINANCE TO AMEND CHAPTER 303,WAUKEE MUNICIPAL CODE,
SECTION 303.148 BY DELETING FROM SAID SECTION THE WORDS "ACCEPTANCE OF
THE IMPROVEMENTS BY THE CITY COUNCIL"AND BY INSERTING IN LIEU
THEREOF:"SUBMlTTING THE FINAL PLAT FOR CITY COUNCIL APPROVAL"SO THAT
SECTION 303.148 READS:"THE SUBDIVIDER SHALL AT THE TIME OF SUBMITTING
THE FINAL PLAT FOR CITY COUNCIL APPROVAL,POST MAINTENANCE BONDS IN
AN AMOUNT DESCRIBED HEREIN AS SUFFICIENT AND AS APPROVED BY THE CITY
ATTORNEY AS TO FORM,SUFFICIENCY AND MANNER OF EXECUTION AS SET
FORTH IN THESE REGULATIONS,"
Section 1.Amendment.Chapter 303.148,Waukee Municipal Code is hereby amended by
deleting limn said section the words:"acceptance of the improvements by the city council"and by
inserting in lien thereof:"submitting the final plat for city council approval"so that Section 303.148
reads as follows:
303.148 Posted.The Subdivider shall at the time of
submitting the final plat for city council approval,post maintenance
bonds in an amount described herein as sufficient and as approved
by the city attomey as to form,sufficiency and manner of execution
as set forth in these regulations."
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions
ofthis ordinance are hereby repealed,
Section 3.Severability Clause.If any section,provision or part of this ordinance shall be
adjudged invalid or unconstitntional,such adjudication shall not affect the validity of the ordinance
as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional.
Section 4.Effective Date.Tins ordinance shall be in effect upon its final passage,
approval and publication as provided by law.
Passed by the City Council of the City of Waukee,Iowa,this 20th day of January 2004,and
approved this zo"day of January 2004.
