AN ORDINANCE TO AMEND CHAPTER 301,WAUKEE MUNICIPAL CODE,
ZONING ORDINANCE OF THE CITY OF WAUKEE,IOWA,BY RE-ZONING AND
CHANGING CERTAIN PROPERTY THEREIN FROM COS (CONSERVA nON AND
OPEN SPACE DISTRICT)TO R-2 (ONE AND TWO F AMIL Y RESIDENTIAL
DISTRICT)AND AMEND THE OFFICIAL ZONING MAP TO SHOW RE-ZONING
(TO BE KNOWN AS SPYGLASS SUBDNISION).
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 301.4 of Chapter 301,Waukee Municipal Code,Zoning
Ordinance of the City,adopting the Official Zoning Map,is hereby amended by changing
the following described real estate from COS (Conservation and Open Space District)to
R-2 (One and Two Family Residential District),and that the Official Zoning Map be
made to reflect such amendment:
A PARCEL OF LAND IN THE NW Yo OF SECTION 5,TOWNSHIP 78 NORTH,
RANGE 26 WEST OF THE 5TH P.M.,CITY OF WAUKEE,DALLAS COUNTY,
IOWA,THAT IS MORE P ARTICULARL Y DESCRIDED AS FOLLOWS:
BEGlNNlNG AT THE S.W.CORNER OF GOVERNMENT LOT 5,SECTION 5,
TOWNSHIP 78 NORTH,RANGE 26 WEST OF THE 5TH P.M.,THENCE
NOO'12'20"W,603.86 FEET ALONG THE WEST LINE OF SAID SECTION TO
A POINT;THENCE N83'lO'06"E,37.22 FEET TO THE POINT OF
BEGlNNlNG;THENCE N83'10'06"W,1279.53 FEET TO A POINT;THENCE
SOO'll '47"E,1090.33 FEET TO A POINT;THENCE S83'16'00"W,1277.00
FEET TO A POINT;THENCE NOO'18'56"W,1087.86 FEET TO THE POINT OF
BEGlNNlNG AND CONTAINING 31.75 ACRES MORE OR LESS.
Also known as a parcel to be known as Spyglass Subdivision.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this
ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect
the validity of the ordinance as a whole or any section,provision,or part thereof not
adjudged invalid or unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its final
passage,approval and publication as provided by law.
Passed by the City Council of the City of Waukee,Iowa,this 5th day of April 2004,and
approved this 5th day of April 2004.The passage of this ordinance is conditioned upon the
resolution ofthe sewer issue occurring within the first 60 days after approval of the
ordinance or the passage of this ordinance is null and void.
