AN ORDINANCE TO AMEND SECTION 303.158(A),WAUKEE MUNICIPAL CODE,
DEVELOPMENT CAPITAL FEES FOR COMMUNITY FACILITIES,WASTEWATER
TREATMENT CAPITAL FEES OF THE CITY OF WAUKEE,IOWA,BY DELETING
SUBSECTION 303.158(A)(3)AND BY DELETING THE TABLE IN SUBSECTION
303.158(A)(4)AND BY INSERTING IN LIEU THEREOF IN SUBSECTION 303.158(A)(3)THE
SENTENCE:"NON-RESIDENTIAL,COMMERCIAL OR OTHER DEVELOPMENT -THE
FEE SHALL BE THE FEE SET OUT IN SUBPARAGRAPH 4 HEREOF."AND BY
INSERTING IN LIEU THEREOF A REVISED TABLE REFLECTING A DOUBLING IN NON-
RESIDENTIAL PER FIXTURE UNIT FEES IN SUBSECTION 303.158(A)(4).
BE IT ORDAlNED by the Council of the City of Waukee:
Section 1.Section 303.158(A).Development Capital Fees for Community Facilities,is
hereby amended by deleting Subsection 303.158(A)(3)and by deleting the table in Subsection
303.158(A)(4),and there is inserted in lieu thereof the following:
§303.158.Development Capital Fees for Community Facilities.As a condition of
approval of a site plan or approval of a building permit,each builder shall be required to file fee
payments computed as follows:
A.Wastewater Treatment Capital Fees:
3.Non-Residential,commercial or other development -the fee shall be the
fee set out in subparagraph 4 hereof.
4.The fees will increase annually based on the following schedule to account
for interest incurred by the City for the Wastewater Treatment Facility
Improvements:(page 2)

Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance shall be
adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance
as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its final passage,approval
and publication as provided by law.
Passed by the City Council of the City of Waukee,Iowa,this 21st day of June 2004,and approved
this 21st day of June 2004.

ON THE BASIS OF 35 PSI PER FIXTURE VALUE.
