AN ORDINANCE TO AMEND CHAPTER 301.27,WAUKEE MUNICIPAL CODE,
PARKING AND LOADING AREAS,SECTION 301.27(B)(6),OFF STREET PARKING AREA
REQUIRED,BY ADDING TO THE "MULTI-FAMILY DWELLING -1 OR 2 BEDROOM -TWO
(2)PARKING SPACES,"THE FOLLOWING:"ONE (1)GARAGE PARKING SPACE MAY BE
COUNTED AS A PARKING SPACE IN FULFILLMENT OF THE PARKING REQUIREMENTS,
PROVIDED THERE IS NO LESS THAN ONE (1)OPEN PARKING SPACE FOR EACH ONE OR
TWO BEDROOM APARTMENT AND ONE (1)NOT RESERVED PARKING SPACE FOR EACH
FIVE ONE OR TWO BEDROOM APARTMENTS;"SO THAT SECTION 301.27(B)(6)READS:
"DWELLINGS -(a)SINGLE FAMILY DWELLING -TWO (2)PARKING SPACES ACCESSIBLE
TO THE STREET.(b)DUPLEX FAMILY DWELLING -FOUR (4)PARKING SPACES
ACCESSIBLE TO THE STREET.(c)MULTI-FAMILY DWELLING -1 OR 2 BEDROOM -TWO
(2)PARKING SPACES PER ONE OR TWO BEDROOM APARTMENT.ONE (1)GARAGE
PARKING SPACE MAY BE COUNTED AS A PARKING SPACE IN FULFILLMENT OF THE
PARKING REQUIREMENTS,PROVIDED THERE IS NO LESS THAN ONE (1)OPEN PARKING
SPACE FOR EACH ONE OR TWO BEDROOM APARTMENT AND ONE NOT RESERVED
PARKING SPACE FOR EACH FIVE ONE OR TWO BEDROOM APARTMENTS."
Section 1.Amendment.Chapter 301.27,Section 301.27(B)(6),Waukee Municipal Code is
hereby amended to read as follows:
§301.27(B)(6)."(a)Single family dwelling:-two (2)parking spaces
accessible to the street;(b)Duplex family dwelling:-four (4)parking spaces accessible to
the street;(c)Multi-family dwelling:-1 or 2 bedroom -two (2)parking spaces per one or
two bedroom apartment.One (1)garage parking space may be counted as a parking space
in fulfillment of the parking requirements,provided there is no less than one (1)open
parking space for each one or two bedroom apartment and one (1)not reserved parking
space for each five one or two bedroom apartments."
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions of this
ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance shall be
adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a
whole or any section,provision,or part thereof not adjudged invalid or unconstitutional,
Section 4.Effective Date.This ordinance shall be in effect upon its fmal passage,approval and
publication as provided by law.
