AN ORDINANCE TO AMEND CHAPTER 301.27,WAUKEE MUNICIPAL
CODE,PARKING AND LOADING AREAS,SECTION 301.27(C)(3),IN CASE OF
ANY BUILDING,STRUCTURE,OR PREMISES,BY ADDING TO SAID
SUBSECTION THE WORDS:"BE SHIELDED AND";BY ADDING THE WORDS:
"AND AWAY FROM THE TRAVELED ROADWAY OF PUBLIC STREETS";AND
BY ADDING THE WORDS "THE C-2 DISTRICT SHALL BE EXEMPT FROM THE
PROVISIONS OF THIS ORDINANCE",SO THAT SAID SECTION READS:"ANY
LIGHTING USED TO ILLUMINATE ANY OFF-STREET PARKING AREA,
INCLUDING ANY COMMERCIAL P ARI<ING LOTS,SHALL BE SHIELDED AND SO
ARRANGED AS TO REFLECT THE LIGHT AWAY FROM ADJOINING PREMISES
IN ANY "R"DISTRICT,AND AWAY FROM THE TRAVELED ROADWAY OF
PUBLIC STREETS.THE C-2 DISTRICT SHALL BE EXEMPT FROM THE
PROVISIONS OF THIS ORDINANCE."
Section 1.Amendment.Chapter 301.27,Section 301.27(C)(3),Waukee Municipal
Code is hereby amended to read as follows:
§301.27(C)(3)."Any lighting used to illuminate any off-street
parking area,including any commercial parking lots,shall be shielded and so
arranged as to reflect the light away from adjoining premises in any "R"
District,and away from the traveled roadway of public streets.The C-2
district shall be exempt from the provisions of this ordinance."
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance
shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity
of the ordinance as a whole or any section,provision,or part thereof not adjudged invalid or
unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its final passage,
approval and publication as provided by law.
