AN ORDINANCE TO AMEND CHAPTER 301,WAUI-cEE MUNICIPAL CODE,
ZONING ORDINANCE OF THE CITY OF WAUKEE,IOWA,BY RE-ZONING AND
CHANGING CERTAIN PROPERTY THEREIN FROM M-1A (LIMITED INDUSTRIAL
DISTRICT)TO C-1 (COMMUNITY AND HIGHWAY SERVICE COMMERCIAL
DISTRICT)AND AMEND THE OFFICIAL ZONING MAP TO SHOW RE-ZONING.
BE IT ORDAINED by the Council ofthe City of Waukee:
Section 1.Section 301.4 of Chapter 301,Waukee Municipal Code,Zoning
Ordinance of the City,Adopting the Official Zoning Map,is hereby amended by
changing the following described real estate from M-1A(Limited Industrial District)to C-
1 (Community and Highway Service Commercial District),and that the Official Zoning
Map be made to reflect such amendment:
Waukee Development,Plat 1 Parcel BLot 3
Also known as the Doug Thie1eke Property,
Section 2.The following uses,typically allowed under C-1 zoning,shall not be
allowed on the subj ect property:
1.Gas station or c-store
2.Night club or tavem
3.Child care center or nursery school
4.Car wash
5.Liquor or beverage store
6.Restaurant or cafe
Section 3.The property must be brought into compliance with current C-1
standards via an approved site plan within two years from the date of passage.A building
perrnit must also be issued within that two year time frame.If either of these items fails to
occur the zoning will revert back to M-1A and all commercial type activities must cease.
Section 4.Repealer.All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
Section 5.Severability Clause.If any section,provision orpart of this
ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect
the validity ofthe ordinance as a whole or any section,provision,or part thereof not
adjudged invalid or unconstitutional.
Section 6.Effective Date.This ordinance shall be in effect upon its final
passage,approval and publication as provided by law.
Passed by the City Council ofthe City of Waukee,Iowa,this 4th day of October 2004,and
approved this 4th day of October 2004.
