HomeMy WebLinkAbout2004-12-20-Ordinance 2498_R-3 Zoning District, Rental Multi-FamilyORDINANCE NO.2498 AN ORDINANCE AMENDING SECTION 301.13,WAUKEE MUNICIPAL CODE,ZONING ORDINANCE OF THE CITY OF WAUKEE,IOWA,"R-3"MULTI- FAMILY RESIDENTIAL DISTRICT,BY REPEALING SECTION 301.13 AND SUBSTITUTING IN LIEU THEREOF SECTION 301.13 "R-3"RENTAL MULTI- FAMILY RESIDENTIAL DISTRICT,AMENDING SPECIFICATIONS AND REGULATIONS FOR THE R-3 DISTRICT TO ALLOW FOR RENTAL OCCUPANCY ONLY;PROVIDING FOR THE ADMINISTRATION AND ENFORCEMENT THEREOF, AND PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT THEREWITH. BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF WAUKEE, IOWA: Section 1.Section 301.13,Waukee Municipal Code,Zoning Ordinance of the City of Waukee,Iowa,"R-3"Multi-Family Residential District,is hereby repealed,and the following ordinance is hereby enacted in lieu thereof: §301.13."R-3"Rental Multi-Family Residential District. The "R-3"District is established to provide for rental multiple family residential uses (apartments). A.Principal Permitted Uses.Only the uses of structures or land listed in this Section shall be permitted in the "R-3"District. 1.Uses permitted in the "R-2"District. 2.Multiple family dwellings intended for rental occupancy (apartments),exclusive of row dwellings and townhomes,consisting of not more than twenty-four (24)dwelling units in one building. January 20,2004 -Ordinance 2453 3.Boarding and Rooming Houses. 4.Nursing,convalescent,and retirement homes. 5.Child care centers and nursery schools. B.Permitted Accessory Uses. 1.Storage garages,where the lot is occupied by multiple dwellings. 2.Accessory uses as permitted in the "R -1"District. 1 C.Bulk Regulatious.The following minimum requirements shall be observed 1 subject to the modifications contained in Section 301.26.Sanitary sewer is required for other than R-l or R-2 residential use. 1.Lot Area:10,000 square feet. 2.Lot Area Per Dwelling Unit:2,500 square feet per milt. 3.Minimum Floor Area:750 square feet per unit,except for efficiency units and one (1)bedroom apartments,which shall be 600 square feet. March 18,2002 -Ordinance #2367 4.Lot Width:75 feet. 5.Front Yard:30 feet;when fronting on the right-of-way of a major thoroughfare shown on the Official Major Street Plan,the front yard shall be measured from the proposed right- of-way line. 6.Side Yards:A total of 15 feet;one side may be reduced 1tonotlessthan7feet;15 feet for any other principal building. 7.Rear Yards:Dwelling -30 feet. Any other principal building -40 feet. 8.Maximum Height:Principal Building -40 feet,Accessory Building -14 feet,except that radio communication towers constructed in compliance with §221.1 of the Waukee Municipal Code may not exceed 45 feet in height. 9.Maximum Number of Stories:Principal Building -3 stories. Accessory Building -1 story. 10.More than one Where more than one principal building is dwelling unit constructed on a lot such principal buildings on a lot:shall be separated by not less than 40 feet and Ithefront,rear and side yards shall be determined considering all principal buildings 2 as one unit. D.Minimum Width Regulation.The minimum dimension ofthe main body of the principal building shall not be less than twenty-four (24)feet. E.Perimeter Foundation Requirement.A permanent perimeter foundation, meeting the Waukee Building Code standards,shall be required for all principal buildings. F.Off-Street Parking and Loading.Spaces for off-street parking and loading shall be provided in accordance with the provisions of Section 301.27. G.Site Plan Requirements.See Chapter 304 of the Municipal Code. H.Minimum Open Space.The total land area devoted to open space and landscaping shall not be less than twenty (20)percent of the gross land area included in the building lot.Such open space shall be maintained as grassed and landscaped area and shall not include access drives,parking areas,structures or buildings;except ornamental structures included as part of the landscaping theme. October 20,2003,Ordinance 2436 Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3.Severability Clause.If any section,provision or part of this ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional. Section 4.Effective Date.This ordinance shall be in effect upon its final passage,approval and publication as provided by law.
