AN ORDINANCE TO AMEND CHAPTER 210,REGULATING AND LICENSING OF
PEDDLERS,SOLICITORS AND TRANSIENT MERCHANTS IN THE CITY OF WAUKEE,
IOWA,BY DELETING 210.3,AND SUBSTITUTING IN LIEU THEREOF A PROVISION
EXEMPTING NEWSPAPER CARRIERS;AND EXEMPTING FARMERS AND GARDINERS
SELLING PRODUCTS OF THEIR OWN GROWING;AND EXEMPTING MERCHANTS
TAKING PART IN THE WAUKEE FARMERS MARKET.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 210.3 of Chapter 210,Regulating and licensing of peddlers,solicitors
and transient merchants and to provide penalties for violations,Waukee Municipal Code,is hereby
deleted,and the following is substituted therefore:
Newspaper carriers are excluded from the provisions of this
ordinance.Farmers and gardeners selling products of their own
growing shall be exempt but must locate on private property witbin a
commercial district.Merchants taking part in the Waukee Farmers
Market and following rules set up by Waukee City Council for the
event,are exempt.
]Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance shall be
adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance
as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its fmal passage,
approval and publication as provided by law.
