AN ORDINANCE TO AMEND CHAPTER 213,WAUKEE MUNICIPAL
CODE PROVIDING FOR REGULATIONS AND LICENSING OF
COMMERCIAL HAULERS OF REFUSE AND PENAL TIES FOR VIOLATIONS,
ORDINANCE OF THE CITY OF WAUKEE,IOWA,BY DELETING SECTION
213.5 OF SAID CHAPTER AND INSERTING IN LIEU THEREOF A REVISED
SECTION 213.5
Section 1.Amendment.Chapter 213,Section 213.5 Waukee Mnnicipal
Code is hereby amended by deleting therefrom "Section 213.5"and inserting in lieu
thereof,the following:
§213.5 Insurance.The Commercial Hauler (hereinafter known as the
"Contractor")shall maintain in full force and effect throughout the term of this Contract
and throughout any extension or renewal thereof the following types of insurance in at
least the limits specified below:
Workmen's Compensation Statutory
General Liability:
Bodily Injury $500,000 each occurrence
$1,000,000 aggregate
Property Damage $50,000 each occurrence
$100,000 aggregate
Automobile Liability:
Bodily Injury $500,000 each person
$500,000 each occurrence
Property Damage $50,000 each occurrence
Excess Umbrella Coverage $5,000,000 each occurrence
All insurance will be by insurers acceptable to the City and authorized to do business in
the State ofIowa.Prior to the commencement of work,the Contractor shall furnish the
City with certificates of insurance or other satisfactory evidence that such insurance has
been produced and is in force.Said policies shall not thereafter be cancelled,permitted
to expire,or be changed without thirty (30)days advance notice to the City.
Section 2.Repealer.All ordinances or parts of ordinances in conflict
with the provisions of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this
ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect
the validity of the ordinance as a whole or any section,provision,or part thereof not
adjudged invalid or unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its
final passage,approval and publication as provided by law.
Passed by the Council this 17th day of June 2002,and approved this lih day of
June 2002.
