AN ORDINANCE TO AMEND CHAPTER 303,LAND SUBDNISION
REGULATIONS,WAUKEE MUNICIPAL CODE,SECTION 303.8,DEFINITIONS,BY
INSERTING THE DEFINTIONS OF DETENTION POND AND RETENTION POND THEREIN
IN ALPHABETICAL ORDER
BE IT ORDAINED by the Council ofthe City of Waukee:
Section 1.Section 303.8,Waukee Municipal Code,Zoning Ordinance,Definitions,City of
Waukee,Iowa is hereby amended by inserting,in alphabetical order,the following subparagraphs:
Detention Pond:A facility constructed to store excess storm runoff associated with
increased basin imperviousness and to discharge this excess at a rate similar to the
rate experienced from the basin without development,in accordance with the Urban
Design Standards for Public Improvements Manual.This facility will normally hold
no water.
Retention Pond:A facility constructed to store excess storm runoff associated with
increased basin imperviousness and to discharge this excess at a rate similar to the
rate experienced from the basin without development,in accordance with the Urban
Design Standards for Public Improvements Manual.This facility will always hold
water,but the level will rise during a rain event.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance shall be
adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance
as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its final passage,
approval and publication as provided by law.
Passed by the City Council of the City of Waukee,Iowa,this 15th day of July 2002,and approved
this 15th day of July 2002.
