AN ORDINANCE TO AMEND CHAPTER 301,WAUKEE MUNICIPAL CODE,
ZONING ORDINANCE OF THE CITY OF WAUKEE,lOW A,BY RE-ZONING AND
CHANGING CERTAIN PROPERTY THEREIN FROM A-I (AGRICULTURAL DISTRICT)
TO C-4 (OFFICE PARK COMMERCIAL DISTRICT);AND AMENDING THE OFFICIAL
ZONING MAP TO SHOW RE-ZONING.
BE IT ORDAINED by the Council ofthe City ofWaulcee:
Section 1.Section 301.4 of Chapter 301,Waukee Municipal Code,Zoning
Ordinance of the City,adopting the Official Zoning Map,is hereby amended by changing the
following described real estate from A-I (Agricultural District)to C-4 (Office Park Commercial
District),and that the Official Zoning Map be made to reflect such amendment.
Parcel A (Right-of-Way)
Commencing as a point of reference at the East Quarter (E 1/4)Corner of
Section 33,Township 79 North,Range 26 West of the 5th P.M.,City of
Waukee,Dallas County,Iowa;Thence SOooOO'OO"E,958.87 feet along the
East Line of the Southeast Quarter (SE 1/4)of said Section 33 to the point
of beginning;Thence continuing SOooOO'OO"E,348.06 feet along said East
Line;Thence S89°58'09"W,50.00 feet;thence NOooOO'OO"E,348.04 feet;
ThenceN89°56'46"E,50.00 feet to the point of beginning.Containing 0.40
acres by survey including 0.26 acres of existing right-of-way easement.
Parcel B (Library Site)
Commencing as a point ofreference at the East Quarter ~E 1/4)Corner of
Section 33,Township 79 North,Range 26 West of the s"P.M.,City of
Waukee,Dallas County,Iowa;thence SOooOO'OO"E,958.87 feet along the
East Line of the Southeast Quarter (SE 1/4)of said Section 33;Thence
S89°56'46"W,50.00 feet to the point of beginning;Thence SOooOO'OO"E,
348.04 feet;Thence S89°58'09"W,586.55 feet;Thence NOoo03'44"E,
347.81 feet;Thence N89°56'46"E,586.17 feet to the point ofbegirming.
Containing 4.68 acres by survey.
NOTES
1.Property descriptions do not match between recorded deeds conveying
this property,See warranty deeds recorded in Book 1999,Page 5227 (Gray
to Schade)and Book 2001,Page 9286 (Schade to Waukee Public Library
Foundation).This property is a renmant parcel of land previously owned
by Gray with parcels to the North,West,and South all being senior in
rights.
2.The "As Recorded"bearings and distances shown on this plat refer to
those called for in deeds granted by Gray.See Book 478,Page 308 (Gray
to Johnson);Book 529,Page 102 (Gray to the American Lutheran Church)
and Book 1999,Page 5227 (Gray to Schade).
Section 2.Repealer,All ordinances or parts of ordinances in conflict with the
provisions ofthis ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance
shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the
ordinance as a whole or any section,provision,or part thereof not adjudged invalid or
unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its final passage,
approval and publication as provided by law.
Passed by the City Council of the City of Waukee,Iowa,this 6th day of August 2001,and
approved this 6th day of August 2001.
