AN ORDINANCE TO AMEND CHAPTER 301,WAUKEE MUNICIPAL CODE,
ZONING ORDINANCE OF THE CITY OF WAUKEE,lOW A,BY RE-ZONING AND
CHANGING CERTAIN PROPERTY THEREIN FROM M-1 (LIGHT INDUSTRIAL
DISTRICT)TO C-1 (COMMUNITY AND HIGHWAY SERVICE COMMERCIAL
DISTRICT);AND AMENDING THE OFFICIAL ZONING MAP TO SHOW RE-ZONING.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 301.4 of Chapter 301,Waukee Municipal Code,Zoning
Ordinance ofthe City,adopting the Official Zoning Map,is hereby amended by changing the
following described real estate from M-1 (Light Industrial District)to C-1 (Community and
Highway Service Commercial District),and that the Official Zoning Map be made to reflect such
amendment.
Parcel "A"of the NW Quarter ofS35,T79N,R26W of the 5th P.M.,
Dallas County,Iowa being more particularly described as follows:
Beginuing at the North Quarter comer of said Section 35;
Thence S 00°03'55"W,along the East line of the Northeast Quarter of the
Northwest Quarter of said Section 35,a distance of795.5 feet,to the
Southeast Comer of said Parcel "A";
Thence N 89°51'22"W,along the South line of said Parcel "A",a distance
of500.00 feet,to the Southwest Comer of said Parcel "A";
Thence N 00°03'55"E,along the West line of said Parcel "A",a distance
of795.50 feet,to a point on the North line of the Northeast Quarter of the
Northwest Quarter of said Section 35,said point also being the Northwest
comer of said Parcel "A";
Thence S 89°51'22"E,along the North line of the Northeast Quarter of
the Northwest Quarter of said Section 35,a distance of 500.00 feet,to the
point of beginning,containing 9.0015 acres more or less;
Section 2.Repealer,All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance
shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity ofthe
ordinance as a whole or any section,provision,or part thereof not adjudged invalid or
unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its final passage,
approval and publication as provided by law.
Passed by the City Council of the City of Waukee,Iowa,this 20th day of August,2001,and
