AN ORDINANCE TO AMEND CHAPTER 301,WAUKEE MUNICIPAL CODE,
BY AMENDING SECTION 301.3,ZONING ORDINANCE THE DEFINITION
OF "KENNEL,"BY SUBSTITUTING LANGUAGE REDUCING THE NUMBER
OF DOGS,CATS ALLOWED IN A RESIDENTIAL DISTRICT FROM 5 TO 3
AND PROVIDING THAT SUCH ANIMALS REGISTERED WITH THE CITY
OF WAUKEE AS OF THE EFFECTIVE DATE OF THIS ORDINANCE SHALL
BE PERMITTED DURING THE PET'S LIFETIME.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 301.3,Waukee Municipal Code,Zoning Ordinance,City of
Waukee,Iowa,is hereby amended by deleting the definition of "Kennel,"and substituting
therefore the following words:
So that said section shall read as follows:
Kennel:The keeping of any dogs,cats,or other household pets of mannnal group
regardless of number,for sale,breeding,boarding or treatment purposes,except in
an animal hospital,veterinary clinic,or pet shop,as may be permitted by law,or the
keeping of more than one (I)dog or cat on vacant property or on property used for
business or commercial purposes,shall constitute a kennel.The keeping of not more
than 3 dogs and 3 cats in a residential district shall not be deemed to be a kennel,
unless kept for sale,breeding,boarding or treatment purposes.Any person keeping
more than three dogs and three cats in a residential district on the effective date of
this ordinance,registered as required by ordinance,may continue to keep such dogs
or cats during the pet's lifetime.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance shall be
adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance
as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its fmal passage,
approval and publication as provided by law.
