AN ORDINANCE TO AMEND CHAPTER 217,WAUKEE MUNIClPAL CODE,BY
DEFINING "KENNEL"BY DELETING THE DEFINITION OF "KENNEL"IN SECTION 217.1
THEREOF AND PROVIDING THAT THE DEFINITION OF KENNEL SHALL BE THE SAME
DEFINITION USED IN SECTION 301.3 OF THE ZONING ORDINANCE OF THE CITY OF
WAUKEE,IOWA.
BE IT ORDAINED by the Council ofthe City of Waukee:
Section 1.Section 217.1,Waukee Municipal Code,an Ordinance to Control Animals
Classified as Dangerous or Vicious in nature,in the City of Waukee,Iowa,is hereby amended by
deleting the defirrition ofthe word,"Kennel",and inserting in lieu thereof the following:
Kennel:The keeping of any dogs,cats,or other household pets of ma111111algroup
regardless of number,for sale,breeding,boarding or treatment purposes,except in
an animal hospital,veterinary clinic,or pet shop,as may be permitted by law,or the
keeping of more than one (1)dog or cat,or on vacant property or on property used
for business or commercial purposes,shall constitute a kennel.The keeping of not
more than 3 dogs and 3 cats in a residential district shall not be deemed to be a
kennel,unless kept for sale,breeding,boarding or treatment purposes,Any person
keeping more than three dogs and three cats in a residential district on the effective
date of this ordinance,registered as required by ordinance,may continue to keep
such dogs or cats during the pet's lifetime.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 3.Severability Clanse.If any section,provision or part of tills ordinance shall be
adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance
as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its final passage,
approval and publication as provided by law.
Passed by the City Council of the City of Waukee,Iowa,this 24TH day of September,2001,and
