AN ORDINANCE TO AUTHORIZE THE CITY COUNCIL,BY RESOLUTION,TO
INCLUDE IN ANY APPLICATION FOR ANNEXATION OF TERRITORY UNDER THE
PROVISIONS OF §368.7,CODE OF IOWA,OR PROVISIONS OF §368.11,CODE OF IOWA,
TO INCLUDE A PROVISION FOR A TRANSITION FOR THE IMPOSITION OF TAXES AS
PROVIDED IN §368.11,SUBSECTION 13,CODE OF IOWA.PROVIDED THAT THE
PROVISION SHALL NOT ALLOW A GREATER EXEMPTION FROM TAXATION THAN
THE TAX EXEMPTION FORMULA SCHEDULE PROVIDED UNDER SECTION 427B.3,
SUBSECTIONS 1 THROUGH 5,AS INCORPORATED IN §315.3,WAUKEE MUNICIPAL
CODE;AND SHALL BE APPLIED IN THE LEVY AND COLLECTION OF TAXES.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Provision For a Transition For the Imposition of City Taxes
Against Property Within an Annexation Area.The Council of the City of
Waukee is hereby authorized,by resolution,to include in any annexation application
for annexation of territory under the provisions of §368.7,Code of Iowa,or
provisions of §368.11,subsection 13,Code of Iowa.Provided that the provision
shall not allow a greater exemption from taxation than the tax exemption formula
schedule provided under Section 427B.3,subsections 1 through 5,as incorporated in
§315.3,Waukee Municipal Code;and shall be applied in the levy and collection of
taxes.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 3.SeyerabjJjfy Clause.If any section,provision or part of this ordinance shall be
adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance
as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional.
Section 4.Effectiye Date,This ordinance shall be in effect upon its final passage,
approval and publication as provided by law.
