AN ORDINANCE TO AMEND §803 UNIFORM FIRE CODE AND THE
UNIFORM FIRE CODE STANDARDS ADOPTED BY REFERENCE AND MADE A
PART OF THE WAUKEE MUNICIPAL CODE,BY ADDING §1104.1 PROVIDING
THAT NO BARBECUE GRILLS OR OTHER DEVICES WHICH PRODUCE ASHES
OR EMBERS SHALL BE OPERATED WITHIN TWENTY (20)FEET OF MULTI-
STORY APARTMENT BUILDINGS;PROVIDED,HOWEVER,THIS PROVISION
SHALL NOT APPLY TO TOWNHOMES.
Section 1.§803 Uniform Fire Code and the Uniform Fire Code Standards
adopted by reference and made a part of the Waukee Municipal Code,is hereby
amended by adding thereto §1104.1 as follows:
§1104.1 Prohibition of Operation of Barbecue Grills or Other Devices Which
Produce Ashes or Embers Within Twenty (20)feet of Multi-Story Apartment
Buildings.No barbecue grills or other devices which produce ashes or embers
shall be operated within twenty (20)feet of multi-story apartment buildings;
provided,however,this provision shall not apply to townhomes.
Section 2.Repealer.In any case where the provisions of this ordinance,the
Uniform Fire Code,or other ordinances of the City of Waukee,shall be found to be in
conflict,and in which establishes the higher standard for the promotion and protection of
the safety of persons and property shall prevail.r
Section 3.Severability Claruse.If any section,provision or part of this
ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect
the validity of the ordinance as a whole or any section,provision,or part thereof not
adjudged invalid or unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its final
passage,approval and publication as provided by law.
Passed by the Council this 5th day of June,2000,and approved this 5th day of
June,2000.
