AN ORDINANCE TO AMEND CHAPTER 301,WAUKEE MUNICIPAL CODE,
ZONING ORDINANCE OF THE CITY OF WAUKEE,IOWA,BY CONDITIONALLY RE-
ZONING AND CHANGING CERTAIN PROPERTY THEREIN FROM A-I (AGRICULTURAL
DISTRICT)TO C-4 (OFFICE PARK COMMERCIAL)AND AMENDING THE OFFICIAL
ZONING MAP TO SHOW SAID RE-ZONING.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 301.4 of Chapter 301,Waukee Municipal Code,Zoning Ordinance
of the City,adopting the Official Zoning Map,is hereby amended by changing the following described
real estate from A-I (Agricultural District)to C-4 (Office Park Commercial District)and that the
Official Zoning Map be made to reflect such amendment:
THE EAST 300 FEET OF THE WEST 400 FEET OF THE SOUTH
326 FEET OF THE EAST liz OF THE SE 'I.,SECTION 36,
TOWNSHIP 79 NORTH,RANGE 26 WEST OF THE 5TH P.M.,
WAUKEE,DALLAS COUNTY,IOWA.
Section 2 Conditional Rezoning.Said Plat is rezoned from A-I (Agricultural
District)to C-4 (Office Park Commercial District)upon the condition that construction be in
accordance with the architectural rendering and site plan presented to the City Council and staff
.prior to approval of the rezoning,with rezoning to revert to A-I zoning if said structure is not
constructed as submitted.
Section 3.Renealer.All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
Section 4.Severability Clause.If any section,provision or part of this ordinance
shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the
ordinance as a whole or any section,provision,or part thereof not adjudged invalid or
unconstitutional.
Section 5.Effective Date.This ordinance shall be in effect upon its final passage,
approval and publication as provided by law.
Passed by the City Council of the City of Waukee,Iowa,this 3rd day of May,1999,and approved
this 3'd day of May,1999.

Councihnan Gruber,second by Councilman Lyon,to have the City Clerk read an ordinance to rezone
the Munn property from A-I to C-4 in title only.The Mayor asked for a roll call vote:Ayes:Gruber,
Lyon,Peard and Berger.Nays:None.Motion carried 4 to O.

April 19,1999 -Ordinance to Rezone of Munn Property from A-I to C-4.Motion by )
Councilman Peard,second by Councilman Berger to have the Clerk read the ordinance for the 2nd
time in title only.The Mayor asked for a roll call vote:Ayes:Berger,Heath,Gruber and Lyon.Nays:
Peard.Motion carried 4 to 1.
May 3,1999 -Ordinance No.2279 to Rezone Munn Property from A-I to C-4.Motion by
Councilman Gruber,seconded by Councilman Berger,to have the City Clerk read the ordinance for
the third time io title only,with rezoniog conditional to the site plan already presented to staff,with
rezoniog to revert to A-I zoniog if said structure is not constructed as submitted.The Mayor asked
for a roll call vote:Ayes:Gruber,Berger,Peard and Lyon.Nays:None.Motion carried 4 to O.
May 3,1999 -Final Passage.Motion by Councihnan Gruber,second by Councilman Lyon,to place
the ordinance on final passage with rezoning conditional to the site plan already presented to staff,
with rezoning to revert to A-I zoniog if said structure is not constructed as submitted.The Mayor
asked for a roll call vote:Ayes:Gruber,Lyon,Peard and Berger.Nays:None.Motion carried 4 to
O.
