AN ORDINANCE TO AMEND CHAPTER 606,BEER AND LIQUOR,WAUKEE MUNICIPAL
CODE,BY DELETING SAID CHAPTER AND INSERTING IN LIEU THEREOF SECTIONS 606.1,
AND SUBSECTIONS INCORPORATING SECTIONS OF THE CODE OF IOWA,IOWA
ALCOHOLIC BEVERAGE CONTROL ACT BY REFERENCE THERETO,TO THE EXTENT
THAT VIOLATIONS THEREOF CONSTITUTE A SIMPLE MISDEMEANOR.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF WAUKEE,IOWA AS FOLLOWS:
Section 1.Amendment to Section 606,Waukee Municipal Code.Section 606,
Waukee Municipal Code,is hereby amended by deleting said section and inserting in lieu thereof
Section 606.1 and subsections incorporating as follows,so that said sections of the Code ofIowa whose
number follows 606.1A below,incorporated by reference herein,may be referred to and cited as
sections of the Waukee Municipal Code shall as follows:

Attempt To Destroy
Keeping Liquor Where Beer is Sold
Sunday Sales Before New Year's Day IOnlythosesectionsabovewhicharelistedassimplemisdemeanorsbytheCodeofIowa,
shall be enforced as violations of the Waukee Municipal Code.If the punishment for
violation of such section under the Code of Iowa,shall be different from that provided by the
Waukee Municipal Code for a simple misdemeanor,the punishment set out in the Code of
Iowa shall prevail.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
Section 3.Severability.If any section,provision or part of this ordinance shall be
adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance
as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its final passage,
approval and publication as provided by law.
