AN ORDINANCE TO AMEND CHAPTER 301,WAUKEE MUNICIPAL CODE,
ZONING ORDINANCE OF THE CITY OF WAUKEE,IOWA,BY RE-ZONING AND
CHANGING CERTAIN PROPERTY THEREIN FROM A-I (AGRICULTURAL DISTRICT)TO
R-2 (ONE AND TWO FAMILY RESIDENTIAL DISTRICT)AND AMENDING THE OFFICIAL
ZONING MAP TO SHOW RE-ZONING.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 301.4 of Chapter 301,Waukee Municipal Code,Zoning Ordinance of
the City,adopting the Official Zoning Map,is hereby amended by changing the following described
real estate from A-I (Agricultural)to R-2 (One and Two Family Residential District);and that the
Official Zoning Map be made to reflect such amendment:
Beginning at the SW 1/4 of the SE 1/4 of Section 35,Township 79 North,Range 26 West of
the 5th P.M.,Waukee,Dallas County,Iowa,more particularly described as follows:
Commencing at the S1/4 corner of Section 35 T79N R26W;thence NOO-02-47 W along the
west line of SW 1/4 SE 1/4 of said Section 35 for 60.00 feet to the north right-of-way line of
University Avenue also being to the point-of-beginning;thence continuing NOO-02-47 W
along said west line for 1259.58 feet to the north line of the SW 1/4 SE 1/4;thence N89-57-
42 E along said north line for 1321.92 feet to the east line of said SW 1/4 SE 114;thence
SOO-01-52 E along said east line for 1258.71 feet to the north right-of-way line of University
Avenue;thence S89-55-38 W along said north right-of-way line for 320.52 feet;thence NOO-
02-47 W for 638.00 feet;thence S89-05-38 W for 686.05 feet;thence SOO-02-47E for
638.00 feet to the north right-of-way line of University Avenue;thence S89-55-38 Walong
said north right-of-way line for 315.02 feet to the point-of-beginning.This parcel contains
28.16 acres and subject to easements of record.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance shall
be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the
ordinance as a whole or any section,provision,or part thereof not adjudged invalid or
unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its final passage,
approval and publication as provided by law.
