HomeMy WebLinkAbout1998-03-16-Ordinance 2240_Rezoning, Unnamed PropertyORDINANCE NO.2240 AN ORDINANCE TO AMEND CHAPTER 301,WAUKEE MUNICIPAL CODE, ZONING ORDINANCE OF THE CITY OF WAUKEE,IOWA,BY RE-ZONING AND CHANGING CERTAIN PROPERTY THEREIN FROM A-I (AGRICULTURAL DISTRICl)TO C-l (COMMUNITY AND HIGHWAY SERVICE COMMERCIAL DISTRICT),PARCEL(B) FROMA-l (AGRICULTURALDIS1RICT)TOR-3(MULTI-FAMILYRESIDENTIAL),PARCEL ©FROM A-I (AGRICULTURAL DISTRICT)TO R -4 (ROW DWELLING AND CONDOMINIUM DWELLING DISTRICT),AND PARCEL (D)FROM A-I (AGRICULTURAL DISTRICT)TO R-2 (ONE AND TWO F AMIL Y RESIDENTIAL DISTRICT)AND AMENDING THE OFFICIAL ZONING MAP TO SHOW RE-ZONING. BE IT ORDAINED by the Council of the City of Waukee: Section 1.Section 301.4 of Chapter 301,Waukee Municipal Code,Zoning Ordinance of the City,adopting the Official Zoning Map,is hereby amended by changing the described Parcel (A)from A-I (Agricultural District)to C-l-l (Community and Highway Service Commercial District),Parcel(B)from A-I (Agricultural District)to R-3(Multi-Family Residential),Parcel ©from A-I (Agricultural District)to R -4 (Row Dwelling and Condominium Dwelling District),and Parcel (D)from A-I (Agricultural District)to R- 2(One and Two Family Residential District);and that the Official Zoning Map be made to reflect such amendment: All of said parcels together constitute the property described as government lot four (4)in Section four (4),in township seventy eight (78)north,of range twenty six (26)west of the fifth p.m.,Dallas County,Iowa.Said tract ofland being subject to and together with any and all easements of record. Parcel (A)from A-I (Agricultural District)to C-I (Community and Highway Service Commercial District)legally described as follows:Beginoing at the Northwest Corner of Section 4,Township 78 North,Range 26 West of the 5th P.M.,City of Waukee,Dallas County,Iowa;thence,N89-38'18"E along the North line of said Section 4 a distance of 970.92 feet;thence,N89-44'40"E along the North Line of said Section 4 a distance of338.56 feet;thence,SOO-07'29"W a distance of 59.73 feet to the South Right-of-Way Line of University Avenue as it is presently established,thence,SOO-07'22"W a distance of 300.01 feet;thence,S89-41'53"W a distance of 944.40 feet;thence SOO-06'39"W a distance of 435.01 feet;thence S89-41 '53"W a distance of 40.00 feet to the West Line of said Section 4;thence,NOO-06'39"E along the West Line of said Section 4 a distance of 794.01 feet to the Point of Beginning." Said tract ofland contains 9.431 Acres,more or less. Said tract ofland contains 17.764 Acres,more or less. Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3.Severability Clause.If any section,provision or part of this ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional. Section 4.Effective Date.This ordinance shall be in effect upon its final passage,I approval and publication as provided by law.
