ORDINANCE OF THE CITY OF WAUKEE,IOWA,BY RE-ZONING AND CHANGING
CERTAIN PROPERTY THEREIN FROM A-I (AGRICULTURAL DISTRICT)TO R-l (ONE
FAMILY RESIDENTIAL DISTRICT)AND AMENDING THE OFFICIAL ZONING MAP TO
SHOW RE-ZONING.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 301.4 of Chapter 301,Waukee Municipal Code,Zoning Ordinance
of the City,adopting the Official Zoning Map,is hereby amended by changing the described
Parcel from A-I (Agricultural District)to R-l (One Family Residential District);and that the
Official Zoning Map be made to reflect such amendment:
The Northeast Quarter of the Southwest Quarter of Section 36,Township 79 North,Range
26 West of the 5th P.M.,Waukee,Dallas County,Iowa,except the South 366 feet thereof,
more particularly described as follows:
Beginning at the Northeast Comer of the Southeast Quarter of Section 36,Township
79 North,Range 26 West of the 5th P.M.,Waukee,Dallas County,Iowa;thence
SOO"-OO'-OO"W,along the East Line of the Southeast 1/4 of said Section 36,a
distance of 951.41 feet;thence S89"-46'-33"W,a distance of 1323.65 feet,to a point
on the East Line of Lot 23,Southfork Plat No.1,an Official Plat,Waukee,Dallas
County,Iowa,and to a point on the West Line of the Northeast 1/4 of the Southeast
1/4 of said Section 36;thence NOO"-12'-44"E,along the East Line of Lots 23,28,and
29 of said Southfork Plat No.1,and along the West Line of the Northeast 1/4 of the
Southeast 1/4 of said Section 36,a distance of953.68 feet,to the Northwest Comer
of the Northeast 1/4 of the Southeast 1/4 of said Section 36;thence N89"-52'-24"E,
along the North Line of the Northeast 1/4 of the Southeast 1/4 of said Section 36,a
distance of 1320.11 feet,to the point of beginning.
Said tract of land contains 28.9056 acres more or less.Said tract of land being subject to and
together with any and all easements of record.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance shall
be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance
as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional.
Section 4.Effective Date.Tbis ordinance shall be in effect upon its final passage,
approval and publication as provided by law.
