ORDINANCE NO.2216
AN ORDINANCE TO AMEND CHAPTER 303,WAUKEE MUNICIPAL CODE,
SUBDIVISION REGULATIONS ORDINANCE OF THE CITY OF WAUKEE,IOWA,BY
AMENDING SECTION 303.43 TO ALLOW CONSTRUCTION OF NOT MORE THAN TWO (2)
PRINCIPAL RESIDENTIAL STRUCTURES PRIOR TO APPROVAL OF FINAL PLAT,AFTER
APPROVAL OF SUBDIVISION OF LAND HAS BEEN APPLIED FOR IN PROPERTY ZONED R-l,
R-2,R-4,OR R-5,AND PRELIMINARY PLAT APPROVAL HAS BEEN GRANTED;AND
FURTHER PROVIDING THAT SAID RESIDENCE STRUCTURES SHALL NOT BE OCCUPIED
OR SOLD PRIOR TO FINAL PLAT APPROVAL.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 303.43 of Chapter 303,Waukee Municipal Code,Subdivision Regulations of
the City,is hereby amended by adding thereto the following:
(C)After obtaining preliminary plat approval for property zoned R-l,R-2,R-
4,or R-5,a subdivider may construct not more than two (2)principal
residence structures in a subdivision upon obtaining permit therefore,
provided,however,such structures shall not be occupied or sold prior to
the granting of final plat approval for the subdivision.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions of this
ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance shall be
adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a
whole or any section,provision,or part thereof not adjudged invalid or unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its [mal passage,approval and
publication as provided by law.
