HomeMy WebLinkAbout1997-08-18-Ordinance 2229_Zoning Regulations, Parking Lot BuffersORDINANCE NO.2229 AN ORDINANCE TO AMEND CHAPTER 301 ,WAUKEE MUNIC1P AL CODE, ZONING ORDINANCE OF THE CITY OF WAUKEE,IOWA,BY DELETING SECTION 301.27 (A)2 IN ITS ENTIRETY AND SUBSTITUTING IN LIEU THEREOF LANGUAGE DECREASING THE REQUIRED BUFFER BETWEEN PARKING LOTS AND RESIDENTIAL DISTRICTS WITH EXIS:rING 30 FOOT PERIMETER BUFFER ZONES FROM 25 FEET TO 10 FEET. BE IT ORDAINED by the Council ofthe City of Waukee: Section 1.Section 301.21 of Chapter 301,Waukee Municipal Code,Zoning Ordinance of the City,is hereby amended by deleting paragraph 301.27 (a)2 in its entirety and substituting in lieu thereof the following: "Such space may occupy all or any part of any required yard or court space except where joining an R"district,it shall be set back at least twenty-five (25)feet; provided,however,the set back from adjoining "R"districts with existing thirty (30)foot perimeter buffer zones shall be a minimum of ten (10)feet.All such set backs shall be screen planted". Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3.Severability Clause.If any section,provision or part of this ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provisions,or part thereof not adjudged invalid or unconstitutional. Section 4.Effective Date.This ordinance shall be in effect upon its final passage, approval and publication as provided by law.
