ORDINANCE NO.2210
AN ORDINANCE AMENDING CHAPTER 213A OF THE MUNICIPAL CODE OF THE
CITY OF WAUKEE,PROVIDING FOR THE ASSESSING OF FEES OR CHARGES FOR THE
COLLECTION,PROCESSING AND MARKETING OF SOLID WASTE AND RECYCLABLE
MATERIALS WITHIN THE CITY LIMITS OF THE CITY OF WAUKEE,IOWA,BY AMENDING
§213A.3(C)THEREOF TO INCLUDE MOBILE HOME PARKS WITH MULTIFAMILY
DWELLINGS CONTAINING FOUR (4)OR MORE UNITS HAVING A COMMERCIAL TYPE OF
CONTAINER THAT MAYBE MECHANICALLY EMPTIED.
Section 1.Chapter 213A,Waukee Municipal Code,Assessing of Fees or Charges for the
Collection,Processing and Marketing of Solid Waste and Recyclable Materials Within the City Limits
of the City of Waukee,Iowa,is hereby amended as follows:
A.By adding after the words "mechanically emptied"in the third line of §213A.3(C)
thereof,the words,"and any Mobile Home Park,"and by adding at the end of
§213A.3(C)thereof,the words,"and Mobile Home Parks.Disposition of solid waste
from all mobile homes,and recycling bins at multiple sites will be provided by the
Mobile Home Park owner,who shall be responsible for compliance with ordinances of
the City of Waukee regarding disposition of solid waste and recycling."
so that said sub-paragraph shall read as follows:
C.Any multi-family dwelling containing four (4)or more units having a commercial type of
container that may be mechanically emptied,and any Mobile Home Park,must follow
Waukee Municipal Code provisions relating thereto,covering the mandating of
Recycling at Apartments and Mobile Home Parks.Disposition of solid waste from all
mobile homes,and recycling bins at multiple sites will be provided by the Mobile Home
Park owner,who shall be responsible for compliance with ordinances of the City of
Waukee regarding disposition of solid waste and recycling.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions of this
ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance shall be
adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a
whole or any section,provision,or part thereof not adjudged invalid or unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its final passage,approval and
publication as provided by law.
