AN ORDINANCE TO AMEND CHAPTER 301,WAUKEE MUNICIPAL CODE,
ZONING ORDINANCE OF THE CITY OF WAUKEE,IOWA,BY AMENDING MAXIMUM
HEIGHT LIMITATIONS OF ACCESSORY BUILDINGS IN A-I (AGRICULTURAL
DISTRICT)IN TRACTS OF 10 ACRES OR MORE FROM 14 FEET TO 30 FEET,
AND FROM 14 FEET TO 20 FEET IN TRACTS OF LESS THAN 10 ACRES.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 301.9 C (7)of Chapter 301,Waukee
Municipal Code,Zoning Ordinance of the City,is hereby amended by
deleting said subparagraph,and inserting in lier thereof the
following:
(7)Maximum Height:Principal Building -40 ft.Acces-
sory Building -20 ft.in lots of
less than 10 acres;and 30 ft.in
lots of 10 acres or more;except that
radio communication towers construct-
ed in compliance with S221.1 of the
Waukee Municipal Code may not exceed
45 feet in height.
Section 2.Repealer.All ordinances or parts of ordinances
in conflict with the provisions of this ordinance are hereby repea-
led.
Section 3.Severability Clause.If any section,provlslon
or part of this ordinance shall be adjudged invalid or unconstitu-
tional,such adjudication shall not affect the validity of the
ordinance as a whole or any section,provision,or part thereof not
adjudged invalid or unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect
upon its final passage,approval and publication as provided by
law.
