AN ORDINANCE TO AMEND CHAPTER 301,WAUKEE MUNICIPAL CODE,
ZONING ORDINANCE OF THE CITY OF WAUKEE,IOWA,BY RE-ZONING AND
CHANGING CERTAIN PROPERTY THEREIN FROM A-I (AGRICULTURAL DISTRICT)
TO R-l (SINGLE-FAMILY RESIDENTIAL DISTRICT);AND FROM R-l (SINGLE-
FAMILY RESIDENTIAL DISTRICT)TO R-5 (PLANNED UNIT DEVELOPMENT
DISTRICT);AND AMENDING THE OFFICIAL ZONING MAP TO SHOW RE-ZONING.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 301.4 of Chapter 301,Waukee Municipal
Code,Zoning Ordinance of the City,adopting the Official Zoning
Map,is hereby amended by changing the following described real
estate from A-I (Agricultural District),to R-l (Single family
residential district);and from R-l (Single Family Residential
District),to R-5 (Planned Unit Development District)and that the
Official Zoning Map be made to reflect such amendment:
A parcel of land in the E 1/2 of the SE 1/4 of Section
35,Township 79 North,Range 26 West of the Fifth P.M.,
Dallas County,Iowa,more particularly described as
follows:
The east 1/2 of the SE 1/4 of Section 35,Township 79
North,Range 26 West of the Fifth P.M.,except the north
500.47 feet of the east 726.00 feet and except Lot 1,2,
3 and 4 of Seven Pines and except the north 329.51 feet
of the east 278 feet of the NE 1/4 of the SE 1/4 and
except the north 28.00 feet of the east 278.00 feet of
the SE 1/4 of the SE 1/4 and except the following
described parcel:
An irregularly shaped portion of the SE 1/4 of Section
35,Township 79 North,Range 26 West of the 5th P.M.,
Waukee,Dallas County,Iowa,described as:Commencing at
the SE Corner of said Section 35,thence,NOO·OO'OO"E
along the East line of the SE 1/4 of said Section 35;a
distance of 60.00 feet to the North Right-of-Way line of
University Avenue as it is presently established and to
the Point of Beginning;thence S89·55'44 "W along the
North Right-of-Way line of said University Avenue,a
distance of 623.00 feet;thence NOO·OO'OO"E,a distance
of 325.00 feet;thence,N59·00'00"E,a distance of 515.00
feet;thence,N82·30'00"E,a distance of 149.84 feet;
thence N90·00'00"E,a distance of 33.00 feet to the East
line of the SE 1/4 of said Section 35;thence SOO·OO'OO"
E,thence along the east line of the SE 1/4 of said
Section 35,a distance of 609.03 feet to the point of
beginning.
Section 2.Repealer.All ordinances or parts of ordinances
in conflict with the provisions of this ordinance are hereby

Section 3.Severability Clause.If any section,provision
or part of this ordinance shall be adjudged invalid or unconstitu-
tional,such adjudication shall not affect the validity of the
ordinance as a whole or any section,provision,or part thereof not
adjudged invalid or unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect
upon its final passage,approval and publication as provided by
law.
