WAUKEE CITY COUNCIL MINUTES
August 3, 2020
*Due to public health concerns and guidance, in accordance with Iowa Code Sections
21.4(1)(b) and 21.8, this meeting of the Waukee City Council was conducted electronically as
holding the meeting in person was impossible or impractical.
(A) Call to Order — The regular meeting of the Waukee City Council was called to order by Mayor
Clarke at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom
pursuant to the electronic meeting provisions of Iowa Code Sections 21.4(1)(b) and 21.8.
(B) Pledge of Allegiance (temporarily suspended)
(C) Roll Call — The following members were present: Mayor Courtney Clarke; Council Members
Anna Bergman (electronically), R. Charles Bottenberg (electronically), Chris Crone, Larry R.
Lyon (electronically), Ben Sinclair. Absent: None.
Also in attendance: City Administrator Tim Moerman, Development Services Director Brad
Deets (electronically), Public Works Director/City Engineer Rudy Koester (electronically),
Finance Director Linda Burkhart (electronically), Human Resources Director Michelle Lindsay
(electronically), Marketing & Communications Director Summer Evans (electronically), IT
Director Son Le (electronically), Fire Chief Clint Robinson (electronically), Police Lt. Scott
Cunningham (electronically), City Clerk Rebecca D. Schuett, City Attorney Steve Brick
(electronically).

(E) Agenda Approval — Council Member Crone moved to approve the agenda; seconded by
Council Member Sinclair. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair.
Nays: None. Motion carried 5 — 0.

(G) Public Hearings:
1) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, by
rezoning and changing certain property therein from K-OF/PD-1 to K-MU/PD-1, a
property to be known as Kettlestone Prairie — Mayor Clarke opened the public hearing
and asked if any written correspondence had been received; City Clerk Schuett replied in the
negative. Development Services Director Deets reviewed the site map, noting that the
subject property was part of the larger The Quarter project. The applicant proposes a four-
story building which includes a mix of residential and commercial uses. The planned
development overlay allows for the mixed use and for higher density. Mr. Deets also
reviewed a concept plan for the building and parking, including covered parking with a
"green" canopy. Project developer Ben Eastep and project engineer Keven Crawford (both
participating electronically) introduced themselves in the event of questions. Council
Member Bottenberg asked for the definition of a "green" canopy; Mr. Deets replied that he
understood it to be a structure with living plants on it. No comments were made by the
public in attendance.
2) On the vacation of a public ingress/egress easement [The Shops at Kettlestone North
Plat 1] — Mayor Clarke opened the public hearing and asked if any written correspondence
had been received; City Clerk Schuett replied in the negative. Development Services
Director Deets stated that a new easement has already been approved by the council for a
joint access and that the proposed vacation is a "clean-up" issue. No comments were made
by the public in attendance.
3) On a proposal to enter into an Amended and Restated Agreement for Private
Development with The Quarter at Waukee, L.L.C. and Waukee Prairie Apartments LLC
— Mayor Clarke opened the public hearing and asked if any written correspondence had
been received; City Clerk Schuett replied in the negative. Development Services Director

Deets referenced the original development agreement with Midtown Holdings, LLC, that was
approved in 2019. The planned project has since evolved to a larger development with a
greater minimum assessed value requirement. The amended agreement also proposes to
assign the agreement to two other entities. Mr. Deets reviewed a revised development
concept plan, including an entertainment venue, hotels, commercial development and
parking. The proposed agreement allows for a partial property tax rebate over a series of
years and based on construction within the project area. Property tax revenue generated by
the project will be used by the City for important infrastructure and public amenity projects.
The proposed project aligns with the City's overall economic development and Kettlestone
development vision and is seen as a catalyst for other development in the area. No
comments were made by the public in attendance.
Public Hearing Action Items:
1) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning

2) Resolution: Consideration of approval of a resolution approving the vacation of a
public ingress/egress easement [The Shops at Kett/estone North Plat 1] — Council
Member Crone moved to approve the resolution; seconded by Council Member Lyon.
Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion
carried 5 — 0. (Resolution #2020-276)
3) Resolution: Consideration of approval of a resolution approving and authorizing
execution of an Amended and Restated Agreement for Private Development with The
Quarter at Waukee, L.L.C. and Waukee Prairie Apartments LLC — Council Member Lyon
moved to approve the resolution; seconded by Council Member Crone. Results of vote:
Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 — 0.

2) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning
Ordinance, City of Waukee, by rezoning and changing certain property therein from A-
1 to R-2 and R-4, a property to be known as Autumn Valley [second reading] - Council
Member Crone moved to approve the second reading of the ordinance in title only;
seconded by Council Member Sinclair. Development Services Director Deets briefly
reviewed the Comprehensive Plan for the overall area. He referenced much discussion at
the public hearing for the proposed rezoning, specifically concerning townhomes on the east
side of 10th St. and the overall 10th St. alignment. City staff has worked with the developer
on several possible 10th St. alignments; Mr. Deets added that the proposed zoning areas

would not change at this time and that the final street alignment will be considered during the
platting process. Mr. Deets also said it was his understanding that immediately following the
previous council meeting, the developer spoke with some of the concerned residents. Mayor
Clarke voiced her appreciation for the flexibility of developers in working with existing
neighbors when they voice concerns. Applicant representative Seth Moulton (participating
electronically) addressed the council and stated that the developer took residents' comments
under consideration, speaking with those residents about a possible buffer space behind the
townhomes to the east of 10th St. He believes there was confusion about the project and
stated that the developer made changes in good faith as they wanted to be a good neighbor.
Council Member Crone thanked Mr. Moulton for speaking with the residents and for
presenting new concept plans. Council Member Bergman stated that she had not received
any direct feedback from the concerned residents regarding conversations with Mr. Moulton
so she has no indication if the concerns have been alleviated. Mayor Clarke noted that she
reached out directly to those who spoke at the public hearing, asking that they keep the
council informed, but she heard nothing in response. City Clerk Schuett informed Mayor
Clarke that two participants electronically raised a hand to speak. Mayor Clarke clarified that
this was not a public hearing but stated that due to the number of concerns raised at the
earlier public hearing, she would allow the two comments. 1) Ashley and Steve Kiburz, 770
Gray Ave. (participating electronically), stated that they had spoken with Mr. Moulton
following the previous meeting and it was a good discussion. They clarified that they had not
reached out to council members as they were waiting for this meeting to see what alternates
were proposed. 2) Matt Patterson, 855 9th St. (participating electronically), still expressed
concerns with the proposed R-4 zoning. While he appreciated the comments from the
developer, he feels the neighbors are being told things simply to alleviate concerns and
discourage them from continuing to speak on the matter. He again voiced the desire to keep
townhome zoning away from Clayton Commons, adding that the proposed buffer space was
better than nothing but expressing the hope that neighbor concerns will be heard during the
platting process. Results of vote: Ayes: Bottenberg, Crone, Lyon, Sinclair. Nays: Bergman.
Motion carried 4 — 1.
3) Ordinance: Consideration of approval of an ordinance to amend Chapter 501, Waukee
Municipal Code, regarding the speed limit on SE Waco Place within the city limits of
the City of Waukee, Iowa [second, third (final) readings] — Council Member Crone moved
to approve the second reading of the ordinance in title only, waive the third reading and
place the ordinance on final passage; seconded by Council Member Sinclair. Public Works
Director/City Engineer Koester noted that the proposed ordinance was an effort at traffic
calming; City staff recommend waiving the third reading in order to enact the ordinance
sooner. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None.

the ordinance in title only, waive the third reading and place the ordinance on final passage;
