HomeMy WebLinkAbout2020-08-17-Ordinance 2967_Rezoning, Autumn ValleyORDINANCE NO.2967 AN ORDINANCE TO AMEND CHAPTER 169, ZONING ORDINANCE, CITY OF WAUKEE, IOWA BY AMENDING THE ZONING FROM A-1 (AGRICULTURAL DISTRICT) TO R-2 (ONE & TWO FAMILY RESIDENTIAL DISTRICT) AND R-4 (ROW DWELLING & TOWNHOME DISTRICT) FOR CERTAIN PROPERTY [AUTUMN VALLEY] BE IT ORDAINED by the Council of the City of Waukee: Section 1. Section 169.02 of Chapter 169, Waukee Municipal Code, Zoning Ordinance of the City, adopting the Official Zoning Map, is hereby amended by amending the Zoning from A-1 (Agricultural District) to R-4 (Row Dwelling & Townhome District) for property legally described as follows: AN IRREGULAR SHAPED PORTION OF THE NORTH ONE-HALF OF THE SOUTHEAST QUARTER OF SECTION 32, TOWNSHIP 79 NORTH, RANGE 26 WEST OF THE 5th P.M., WAUKEE, DALLAS COUNTY, IOWA DESCRIBED AS: BEGINNING AT THE NORTHWEST CORNER OF LOT 1 IN CLAYTON ESTATES PLAT 1, AN OFFICIAL PLAT, WAUKEE DALLAS COUNTY, IOWA; THENCE S00°44'10"W ALONG THE WEST LINE OF SAID LOT 1, A DISTANCE OF 122.43 FEET; THENCE S00°41'15"W ALONG THE WEST LINE OF SAID LOT 1 AND ALONG THE WEST LINE OF SAID CLAYTON ESTATES PLAT 1, AND ALONG THE WEST LINE OF CLAYTON ESTATES PLAT 2, AN OFFICIAL PLAT, WAUKEE DALLAS COUNTY, IOWA, A DISTANCE OF 890.30 FEET TO THE SOUTHWEST CORNER OF LOT 32 IN SAID CLAYTON ESTATES PLAT 2; THENCE N89044'25"W, A DISTANCE OF 523.15 FEET; THENCE N84°04'20"W, A DISTANCE OF 612.60 FEET; THENCE N89°44'25"W, A DISTANCE OF 290.70 FEET; THENCE N18°14'50"W, A DISTANCE OF 682.35 FEET; THENCE N09°12'10"W, A DISTANCE OF 309.34 FEET TO THE SOUTHWEST CORNER OF OUTLOT "Z" IN SPRING CREST PLAT 2, AN OFFICIAL PLAT, WAUKEE DALLAS COUNTY, IOWA; THENCE N89°44'26"E ALONG THE SOUTH LINE OF SAID SPRING CREST PLAT 2 AND ALONG THE SOUTH LINE OF SPRING CREST PLAT 1, AN OFFICIAL PLAT, WAUKEE DALLAS COUNTY, IOWA TO THE SOUTHEAST CORNER OF LOT 9 IN SAID SPRING CREST PLAT 1 AND TO THE POINT OF BEGINNING. SAID TRACT OF LAND CONTAINS 35.66 ACRES. Section 2. Section 169.02 of Chapter 169, Waukee Municipal Code, Zoning Ordinance of the City, adopting the Official Zoning Map, is hereby amended by amending the Zoning from A-1 (Agricultural District) to R-4 (Row Dwelling & Townhome District) for property legally described as follows: AN IRREGULAR SHAPED PORTION OF THE NORTH ONE-HALF OF THE SOUTHEAST QUARTER OF SECTION 32, TOWNSHIP 79 NORTH, RANGE 26 WEST OF THE 5th P.M., WAUKEE, DALLAS COUNTY, IOWA DESCRIBED AS: BEGINNING AT THE NORTHWEST CORNER OF LOT 30 IN CLAYTON ESTATES PLAT 2, AN OFFICIAL PLAT, WAUKEE DALLAS COUNTY, IOWA; THENCE S00°41'15"W ALONG THE WEST LINE OF SAID CLAYTON ESTATES PLAT 2, A DISTANCE OF 270.00 FEET; THENCE N89044'25"W, A DISTANCE OF 1310.80 FEET; THENCE N18°14'50"W, A DISTANCE OF 348.53 FEET; THENCE S89044'25"E, A DISTANCE OF 290.70 FEET; THENCE S84°04'20"E, A DISTANCE OF 612.60 FEET; THENCE S89°4425"E, A DISTANCE OF 523.15 FEET TO THE POINT OF BEGINNING. SAID TRACT OF LAND CONTAINS 9.22 ACRES. Section 3. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision, or part thereof not adjudged invalid or unconstitutional. Section 5. Effective Date. This ordinance shall be in effect upon its final passage, approval and publication as provided by law.
