HomeMy WebLinkAbout1992-04-06-Ordinance 2152_Hazardous Materials FeesORDINANCE NO.2152 AN ORDINANCE TO AMEND CHAPTER 220,WAUKEE MUNICIPAL CODE, Hazardous Substances,by Section 220.3(a),to provide a fee schedule for assessing to persons having control over hazardous substance the cost of clean-up by city personnel of a hazardous waste spill. BE IT ORDAINED by the Council of the City of Waukee: Section 1.Amendment.Chapter 220,Waukee Municipal Code, Hazardous Substances,is hereby amended by adding thereto Section 220.3(a)as follows: §220.3(a)The following fees will be assessed and collected by the City of Waukee from persons having control over hazardous substances where such hazardous substances have been spilled and the City of Waukee personnel have participated in the clean-up: PERSONNEL AND EQUIPMENT HOURLY RATE Fire Department Command Car with Chief Officer $ Engine Company Rescue Company Ambulance Crew Additional Personnel (each person) 30.00 60.00 50.00 50.00 15.00 Police Department Patrol Car with Officer $ Additional Personnel (each person) 40.00 15.00 Public Works Department Heavy Equipment with Operator Light Equipment with Operator Additional Personnel 50.00 30.00 15.00 Expendable equipment,materials and/or supplies shall be reimbursed at cost plus 10%handling charge. A minimum responses. charged to of one hour shall be charged for all clean-up For the purpose of computing fees,hours shall be the nearest quarter hour.X Heavy equipment shall be defined as and include the following: Grader,backhoe,dump truck,endloader,sweeper,sewer jet, and similar equipment. Light equipment shall be defined as and include the following: Pickup truck and/or generator and compressor with related power equipment • .Clean-up of city equipment following its use will be charged at the above hourly rate for equipment and operator. Down time on equipment caused by its use in clean-up shall be billed at the above hourly rate. Clean-up costs incurred by the city,including charges to the city by third parties,shall be billed directly to persons having control over hazardous substance as defined herein. Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3.Severability Clause.If any section,provision or part of this ordinance shall be adjudged invalid or unconstitu- tional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional. Section 4.Effective Date.This ordinance shall be in effect upon its final passage,approval and publication as provided by law.
