HomeMy WebLinkAbout1992-06-15-Ordinance 2157_Rezoning, Unnamed PropertyORDINANCE NO.2157 AN ORDINANCE TO AMEND CHAPTER 301,WAUKEE MUNICIPAL CODE, ZONING ORDINANCE OF THE CITY OF WAUKEE,IOWA,BY RE-ZONING AND CHANGING CERTAIN PROPERTY THEREIN FROM R-2 (ONE AND TWO FAMILY RESIDENTIAL DISTRICT)TO R-3 (MULTI-FAMILY RESIDENTIAL DISTRICT); AND AMENDING THE OFFICIAL ZONING MAP TO SHOW RE-ZONING. BE IT ORDAINED by the Council of the City of Waukee: Section 1.section 301.4 of Chapter 301,Waukee Municipal Code,Zoning Ordinance of the City,adopting the Official Zoning Map,is hereby amended by changing the following described real estate from R-2 (One and Two Family Residential District)to R-3 (Multi-family Residential District),and that the Official Zoning Map be made to reflect such amendment: The East 264 Feet of the South 415.40 Feet of the North 827.40 Feet of the following described tract of land:(An irregular shaped tract of land that is located in the NE~of section 33 T79N R26 West of the 5th P.M.,Waukee, Dallas County,Iowa,which lies South of the South Right- of-Way Line of U.S.Highway No.6,as it is presently established),all of which is more accurately described as follows:Commencing at the North ~Corner of said section 33,thence S89"57'30"E,along the North Line of the NE~of said Sec.33,76.17 feet,thence S89"02'30"W, 50.0 feet,to a point that is on the South Right-of-Way Line of said U.S.Highway No.6,thence S89"57'30"E, parallel with the and 50.0 Feet South of the North Line of the NE~of said section 33 and along the South Right- of-Way Line of said U.S.Highway No.6,706.92 Feet,to the POINT OF BEGINNING,thence continuing S89"57'30"E, parallel with and 50.0 Feet South of the North Line of the NE~of said Section 33 and along the South Right-of- Way Line of said U.S.Highway No.6,528.2 Feet,thence SO"04'54"E,1924.03 Feet,to a point that is on the Northerly Right-of-Way of said Chicago and Northwestern Railroad,thence N63"16'03"W,parallel with and 50.0 Feet normally distant from the North of the Center Line of said Chicago and Northwestern Railroad and along the Northerly Right-=of-Way Line of said Chicago and North- western Railroad,580.13 Feet,thence North 0"26'30"W, parallel with and 975.0 Feet East of the Center Line of 4th Street,as it is presently established,1663.51 Feet, to the POINT OF BEGINNING.Said tract of land being subject to and together with any and all easements of record. Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3.Severability Clause.If any section,provision or part of this ordinance shall be adjudged invalid or unconstitu- tional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional. Section 4.Effective Date.This ordinance shall be in effect upon its final passage,approval and publication as provided by law.
