AN ORDINANCE TO AMEND CHAPTER 301,WAUKEE MUNICIPAL CODE,
ZONING ORDINANCE OF THE CITY OF WAUKEE,IOWA,BY RE-ZONING AND
CHANGING CERTAIN PROPERTY THEREIN FROM A-I (AGRICULTURAL DISTRICT)
TO R-5 (PLANNED UNIT DEVELOPMENT);AND AMENDING THE OFFICIAL ZONING
MAP TO SHOW RE-ZONING.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 301.4 of Chapter 301,Waukee Municipal
Code,Zoning Ordinance of the City,adopting the Official Zoning
Map,is hereby amended by changing the following described real
estate from A-I (Agricultural District)to R-5 (Planned unit
Development),and that the Official Zoning Map be made to reflect
such amendment:
A parcel of land in the west ..of the southwest J.o of
section 36,Township 79 North,Range 26 West of the 5th
P.M.,City of Waukee,Dallas County,Iowa,that is more
particularly described as follows:
Commencing as a point of reference at the southwest
corner of Section 36,said point being on the centerline
of University Avenue;thence NOo024'05"E,680.00 feet
along the west line of Section 36,said line also being
the centerline of NW 156th Street,to the point of
beginning;thence continuing NOo024'05"E,1285.10 feet
along said west line to a point;thence S89°35'55"E,
763.00 feet to a point;thence N07°02'29"E,679.46 feet
to a point on the south line of Outlot "D",County Club
West Plat 1,an official plat in Clive,Iowa;thence
S89°56'56"E,492.99 feet along said south line to the
northwest corner of Southfork Plat 2,an official plat;
thence SOo040'10"W,2579.05 feet along the west line of
Southfork Plat 2 to a point on the north right-of-way
line of University Avenue;thence N89°46'18"W,512.49
feet along said north right-of-way line to a point;
thence NOO °24'05 "E,450.00 feet to a point;thence
N57°26'15"W,317.82 feet to a point;thence N89°46'18"W,
540.93 feet to the point of beginning and containing
55.207 acres more or less.
Section 2.Repealer.All ordinances or parts of ordinances
in conflict with the provisions of this ordinance are hereby
repealed.
Section 3.Severability Clause.If any section,provision
or part of this ordinance shall be adjudged invalid or unconstitu-
tional,such adjudication shall not affect the validity of the
ordinance as a whole or any section,provision,or part thereof not
adjudged invalid or unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect
upon its final passage,approval and publication as provided by
law.
Passed by the City Council of the City of Waukee,Iowa,this 5th
