CONSTRUCTION AND THE CITY OF WAUKEE, BE IT ORDAINED by the Council of the City of Waukee: Section 1.THERE SHALL BE ADDED TO THE WAUKEE MUNICIPAL CODE,CHAPTER 221 AS FOLLOWS: §22l.1 Communication Towers.Communication Towers constructed in the City of Waukee,Iowa,shall meet all of the following requirements: a.Maximum tower height to be 45 feet from tip to ground level.Antenna and mast on the tower must con form to sound eng ineering practices.Guy wires are to be installed per manufacturer's recommenda- tions on applicable models. b.Guy wire supports and anchors are to be lo- cated one foot inside property boundaries or utility easement,and of design to conform to current methods recommended by manufacturer's specifications or other applicable requirements. c.An anti-climbing apparatus is to be install- ed to prevent unauthorized ascension on all communi- cation towers except All Band Vertical Antennas. d.Tower height plus five feet shall not exceed angular distance from base to overhead lines or per- manent neighboring domicile.Exception:Towers with guy wires that are rated for collapsible distance, the collapsible distance plus five feet may be used. e.If the tower is located near a recreation area,shelter buildings will be considered as perman- ent domiciles. f.Each location is permitted one tower over 14 feet only. g.All towers shall be erected or maintained to the rear of the main building,except in those in- stances when the subject property is a cul-de-sac or corner lot where the side yard is larger than the rear yard in which case a permit may be requested for a side yard tower location. h.The tower is to be grounded per manufactur- er's recommendations. i ,All towers shall be constructed in compli- ance with the Uniform Building Code as amended. j.A certificate of insurance shall be obtained and furn ished to the Ci ty of Waukee,Iowa,by the person constructing a communication tower or the owner of the property on which the tower is located, showing compliance with this ordinance with $200,000.00 liability coverage and a notarized Affidavit by the owner showing that the tower was installed per MFG specifications. §221.2 Penalty.Any person,firm or corporation violating any provisions of this ordinance shall be quilty of a simple mesderneanor and upon conviction thereof shall be punished by a fine not exceeding one hundred dollars ($100.00)r or imprisonment not ex- ceed ing thi rty (30)days.Each day upon which such violation occurs after notice shall constitute a separate violation. §221.3 Severability.If any section,provision or part of this ordinance shall be adjudged invalid or unconstitutional,such adjUdication shall not affect the validity of the ordinance as a whole or any section,provision or part thereof not adjudged invalid or unconstitutional.
